COVID-19와 국제인권법의 역할

국문 초록 (Abstract)

COVID-19 사태로 인해 많은 국가에서 감염병 예방 및 확산 방지를 위한 긴급대응조치들이 취해지고 있다. 문제는 이러한 조치들로 인해 인권이 지속적으로 심각하게 침해되거나 필요이상으로 제한받고 있지만, 모순되게도 많은 사람들은 현상황을 비정상이 아닌 일상적인 것으로 점차 보기 시작한다는 것이다. 이에 본 논문은 과연 개별 국가들의 감염병 대응 조치들이 인권 침해적 요소를 가지고 있음에도 정당한 제한이 될 수 있는지, 있다면 이를 판단하는 법적 근거는 무엇인지를 세계보건기구의 국제보건규칙과 주요 국제인권규범을 중심으로 검토한다. 아울러 현 COVID-19 상황에서 유엔 인권기구들은 어떻게 국제적으로 대처하고 있는지와 동시에 국내적으로는 어떠한 인권 문제들이 제기되고 있는지를 살펴 본다.

다국어 초록 (Multilingual Abstract)

Following the outbreak of the COVID-19, most of the countries have introduced containment measures in a global public health emergency. The problem is that by implementing such emergency measures, many governments have restricted human rights in many areas. However, people see it not as abnormal, but as the new normal. Whether such national actions can be a just limitation & derogation of human rights, and if so, what is the legal ground are key research questions of this paper. Therefore, this paper carefully examines the WHO’s international health regulations and relevant international human rights norms. Furthermore, it will review UN human rights institutions’ effort against the COVID-19 crisis and then the national response to COVID-19 in South Korea, focusing on its impact on human rights.
