1945~50년 ‘檢察司法’의 재건과 ‘사상검찰’의 ‘反共司法’ = Reorganization of the ‘Prosecutor-dominating Justice’ and ‘Anti-Communist Justice’ of the ‘Thought-Prosecutor(SisouKensatu)’, 1945-50

This study aims to analyze historically the reemerge of ‘thought-prosecutor (sisoukensatu)’ and the establishment of ‘prosecutor-dominating justice’, which is attributed to its reappearance, and how it functions and effects.
After ‘liberation’, the past thought-prosecutor of colony has gone. American military government in Korea kept and reused the remaining colonial governmental institutions for efficient governing, like police system. However, in terms of the prosecution, it built a policy and implementation removal of prosecutor-dominating justice which is format of Japanese colonial government. In this circumstance, the Korean prosecution officers were taken its former mighty power then forced to wrestle with the police and the court unlike past-liberation time. To face this hard times, the prosecution tried to give rebirth and authority to ‘thought-prosecutor’ as its hidden card for recovery. It was not so successful toward its intention, however, after the establishment of the Republic of Korea government, reorganization of thought-prosecutors and reinforcement of the prosecution’s power in strong interaction with establishment of National Security Law. As a result, in 1949, prosecutor Oh Je-Do and his office, information department of the Seoul prosecutor’s office began to build national organization of thought-prosecutors. By then the prosecutors took advantages on power-game with the police, the military police (military-investigation institute) and the Defense Security Command of Army (military information department) during its aggressive activities on ideology war. It became the key to build up so-called ‘Anti-Communist Justice’. At last, the colonial thoughtprosecutors were given rebirth from these circumstances and the public securityprosecutors of Korea finally emerged.
