기후변화와 재산권 - 해안토지 관련 재산권과 사용권의 충돌 - = Global Warming and Property - Conflicts between Private Property Rights and Public Access to Beach -

국문 초록 (Abstract)

현재 전 세계는 지구온난화로 인한 기후변화로 폭풍, 해수면 상승등의 현상을 직면하고 있으며, 이는 재산권으로 보장되어오던 토지에 대하여 전에 없던 문제를 던져주고 있다. 그에 따라 그 동안 재산권으로 강력하게 보호되어 오던 자원의재분배 필요성이 더욱 부각되기 시작하였다. 재산권의 제한 혹은 변화라는 문제는 이미 20세기 중반부터 환경보호를 위하여 그 필요성이 대두되어 왔고 사람들은 그에 비교적 익숙하여져 있으나, 지구온난화로 인한 급격한 자연환경변화로 인한재산권의 적극적인 제한 혹은 변화에 대해서는 활발히 논의되어 온 주제는 아니다. 미국은 지구온난화 문제가 본격화되기 이전부터 해안토지변화를 점차적 변화의경우와 급격한 변화의 경우를 나누어 증감된 토지의 소유권 귀속문제를 해결하고있다. 한편, 특히 마른모래지역에 대한 공중의 사용권을 인정할 수 있는가, 그리고 그 반사경으로서 소유자에게 공중의 사용을 수인할 의무가 있는가 문제에 대해서는 각 주마다 입장을 달리하고 있다. 다만, 연방대법원은 전반적으로 공중의 이익보다는 해변토지소유자의 이익에 충실한 입장이다. 환경의 동태적 변화에 따라 나타나는 국민들 사이의 재산권 문제는 다른 국민들의 이익, 예컨대 공중의 해변이용권 등과 비교형량하여 조정할 필요가 있다. 과거와달리 재산권의 내용 및 범위와 관련하여 다른 국민들의 이익과의 형량을 통한 탄력적 해석이 필요한 장면이 더욱 더 많아지고 있다. 최근의 급격한 기후변화 사태 및 그로 인한 해변토지 변화는 공중의 이익과 해변토지 소유자들의 재산권 사이의 적절한 이익형량을 요구하고 있다.

다국어 초록 (Multilingual Abstract)

Now, most countries in the world are facing storms, flood, and rising of sea levels due to global warming. This casts a doubt on lands to which the property rights have been guaranteed and at the same time it starts requiring property resources to be redistributed. Especially beach lands are at the center of drastic restriction or changes of property rights. In Fact, some argue that restricting or changing the property rights are needed for environmental preservation. Nevertheless, it is a different story for beach lands which need drastic restrictions or changes on property rights to adjust climate changes. This paper focuses on studying restriction on lands of beach under the title of “Global Warming and Property.” Global warming causes climate changes and the climate changes requires us to reconsider property rights to a) lands of beach and b) water right. With the reasons of limited spaces, this paper focuses owe beach lands. The United States is out to solve property issues related with lands of beach by distinguishing their gradual and radical changes. On the other hands, when it comes to whether rights to beach (dry sand area) should be authorized to the public and whether owners of beach should open their property to public, states have different opinions. The Federal Supreme Court seems that private property rights weigh public interests. Property issues especially related with radial climate changes requires new and proper interest balancing between private property owners and public access to beach.
