압류금지 노무비 제도에 대한 고찰 -건설현장 대금지급구조의 공정성을 중심으로-

국문 초록 (Abstract)

건설현장의 다단계 하도급 구조상 발주자, 수급인, 하수급인, 재하수급인 등 부실한 수급인 또는 하수급인 및 재하수급인과 채권자 사이에 분쟁이 격화되고 있다. 이러한 분쟁 중에서 하수급인의 부실로 인해 발생하는 체불 문제가 심각해지고 있는데, 현행 건설산업기본법에 따른 압류금지 노무비 규정은 그 입법취지와 달리 하수급인의 부실에 의한 체불문제를 해결할 수 없는 구조로 되어 있어 문제이다. 이에 건설현장에서 흔히 발생하는 하수급인의 부실과 관련한 대금지급분쟁을 최소화하기 위하여 건설산업기본법령상 압류금지 노무비 규정이 최하위 일용노무자가 직상 수급인으로부터 체불당한 노임까지 적용될 수 있도록 하고 발주자로부터 최하위 일용노무자에게까지 원활하게 도급대금 직접 지급이 이루어져야 할 것이다.

다국어 초록 (Multilingual Abstract)

Due to the multistage subcontracting structure of construction sites, disputes are intensifying between unhealthy or sewage subcontractors, such as orderers, subcontractors, sewage subcontractors, and on-site subcontractors and creditors.
Amid these disputes, the unpaid problem caused by the dishonesty of sewage contractors has become increasingly serious. However, unlike the purpose of the legislation, the current provisions of the Construction Industry Basic Act that prohibit seizure of sewage contractors are not able to solve the unpaid problem caused by the dishonesty of sewage contractors.
On the other hand, in order to minimize disputes related to poor sewage contractors that occur frequently in construction sites, the provisions of the Construction Industry Basic Act on the prohibition of seizure must be applied to the lowest-ranking day worker from the immediate recipient to the unpaid wages, and direct payment of contract fees must be made smoothly from the orderer to the lowest-ranking day worker.
