헌법문제로서의 전관예우 방지 = Constitutional Approach on “Revolving Doors”: With Some Proposals against Privatization of Publicness

국문 초록 (Abstract)

우리 국가영역에서 가장 큰 문제로 대두되고 있는 현상중의 하나가 전관예우이다. 국가적 의사결정의 과정에 깊이 관여하던 공무원이 그 직을 그만 두자마자 사적 이익의 대리인이 되어 이 정책과정에 되돌아오는 현상은 공적 업무를 사적 이익에 종속시키고 따라서 국가작용을 사유화하는 결과를 야기하게 된다. 개발독재식의 산업화과정에서 관료체제가 주된 정책결정주체로 정착되어온 우리의 역사적 경험은 이런 전관예우가 야기하는 심각한 헌법적 문제를 암시한다. 그것은 사적 이익이 공적 이익을 대체하기 위하여 법치주의를 형해화시킬 뿐 아니라 정책결정과정을 인적 연고에 의하여 폐쇄적으로 운영하게 만든다는 점에서 민주주의에 반한다. 뿐만 아니라 공익의 고려는 애초부터 배제하게 된다. 이에 우리 사회는 전관예우를 예방하기 위한 몇 가지 입법을 행하였다. 사법부문에서의 전직법관·검찰관의 전관예우를 막기 위해 개정된 변호사법은 전직 법원·검찰청의 사무를 일정기간 동안 취급하지 못하도록 하였다. 또 공직자윤리법은 취업제한의 방식을 취하되 일정한 경우 행위제한도 할 수 있는 여지를 마련하였다. 하지만, 이런 법률적 조치만으로는 사회구조적 현상으로서의 전관예우가 원천적으로 없어지기 어렵다. 이에 이 글은 로비를 양성화하는 법제의 마련과 함께 사법의 민주화를 중심으로 하는 사법개혁의 필요성을 제안하고자 한다.

다국어 초록 (Multilingual Abstract)

The retired officials who comes to his former office through revolving doors as soon as he retires the office, are usually seeking somewhat preferential treatments by their former colleague officials for the private interests that they represent. They are trying to mobilize the personal networks that they have made and accumulated during they were in offices and transfer those networks into the platforms on which their clients could pursue their private interests at the cost of the public interests. The problem is that such behaviors have been structured as habitus of the public policy processes in Korea. The revolving doors phenomena tend to privatize the power of the public so that the public policy processes are dominated by the arbitrary exercise of public authorities. It tends to shut down so many channels which used to be open to the society in policy making process, which can significantly harm the democratic process of policy making that should be actively operated in the policy processes. It can lessen the possibility of the responsibility of the government as well, because the processes can be effectively concealed behind the personalized network of the officials. The public interest and/or virtu will be significantly diminished by such a privatized processes.
In order to stop such mal-practice of the revolving doors, this paper tries to introduce the legalization of political lobby system, according to which every lobby activities should be reported to the public who will oversee the process of the lobbying. As to the judicial branch, the most effective way of prevent the mal-practices is democratization of the judicial processes. Democratic check by the people is the best and the only method to stop the harmful effects of the revolving doors phenomena.
