주민투표법상의 투표운동과 관련된 몇 가지 쟁점

국문 초록 (Abstract)

주민투표법이 시행된 지 10년이 되었는데, 그 사이 몇 번의 주민투표가 있었고, 그때마다 투표운동과 투표참여운동 내지 불참운동이 있곤 하였다. 주민투표의 핵심적 영향력은 무엇보다 특정한 결정내용에 대한 동의를 표현함 으로써 그 결정의 정당성을 확보해 주는데 있다. 그리고 그러한 동의는 공동체의 이익을 위한 숙고의 결과 형성된 의견의 표현이어야 한다. 그러한 동의가 숙고의 결과가 될 수 있도록 하기 이한 직접적 조건으로서 주민투표운동의 규제는 매우 중요한 의미를 가진다. 주민투표가 심의 또는 숙고의 과정과 잘 연계되도록 하기 위하여 관련된 정보가 주민들에게 충실히 제공되고, 주민들이 이를 바탕으로 활발 히 의견교환을 하는 과정이 필수적이라 할 수 있다. 이를 위해서는 주민투표법상의 투표운동에 대하여 정확한 개념정의가 필요할 것이다. 주민투표법상 투표운동의 개념이 불명확하고 투표참여운동이나 불참운동 이 투표운동에 해당하는지 여부가 불문명하고 선거관리위원회의 해석을 통하여 확 정되어서는 안될 것이다. 주민투표법에 의하면 전체 투표수가 주민투표권자 총수 의 3분의 1에 미달되는 때에는 개표를 하지 않도록 되어 있으므로 투표참여운동과 불참운동은 공직선거법에서의 선거참여운동과 불참운동과는 다른 의미를 가지게 될 수 있다. 즉 주민투표에서 불참운동은 안건에 대한 반대의 효과로 나타나게 되 는 것이다. 따라서 주민투표법이 이에 대한 정비가 필요하다고 할 수 있다. 이 외에도 주민투표에서 투표운동의 주체에서 지방의회 의원을 제외한 모든 공 무원으로 한 것은 너무 제한적이므로 국공립대학의 교수 등에게는 투표운동을 허용 할 필요가 있고, 주민투표안에 대한 찬･반 운동 단체 지정도 주민투표법에서 규정 할 필요가 있다. 주민투표법에는 아직도 ‘공직선거법’이 아닌 ‘공직선거 및 선거부 정 방지법’으로 규정되어 있는 조문이 있다(예를 들어 제6조 3항, 제11조 제1항 등). 주민투표법이 시행된 지 10년이 지났지만 아직도 개선해야 할 점이 많이 있다. 특히 주민투표법의 개정을 통하여 지역주민의 의사가 올바르게 주민투표를 통하여 반영될 수 있도록 하여야 할 것이다.

다국어 초록 (Multilingual Abstract)

The Residents voting Act is to enhance democracy in and accountability of local autonomy administration and to promote welfare of residents by prescribing matters concerning objects, proposers, requirements for proposal, procedures for residents' voting under Article 14 of the Local Autonomy Act to guarantee a direct participation of residents in main decisions of local government. Matters referred to the Residents' voting shall be decided by vote of not less than 1/3 of the total number of resident voters and by obtaining votes of a majority of the number of valid votes. Campaign on Residents voting is delicate. The term electoral campaign in this Act means activities to have residents approve or disapprove matters referred to residents' voting, or support one of two matters referred to residents' voting: Provided, That a simple statement of his/her views and declaration of intention on matters referred to residents' voting shall not be deemed an electoral campaign. The head of a local government shall offer various information and materials concerning residents' voting through diverse means, such as an official gazette of a local government, daily news papers, the Internet, etc. so that residents may make a correct and objective judgment and a reasonable decision in connection with residents' voting. But they can't conduct an electoral campaign. The election administration committee acknowledges that the participant and the Residents voting boycott movement is a kind of electoral campaign. But there is no article about the participant and the residents voting boycott movement. It have to revise the Residents voting Act for the movement participating residents voting and the boycott movement.
