노인학대의 형사정책적 대응

국문 초록 (Abstract)

우리나라는 2000년 7월부터 65세 이상의 노령인구가 7%대를 넘어서면서 UN기준에 따른 고령화 사회에 진입하였고, 2019년에는 14%를 넘어 고령사회가 될 전망이다. 노인 인구의 증가는 노인 학대 문제로 관심을 불러일으키기에 충분하다. 그러나 우리나라에서 주로 다루는 범죄 양상은 주로 청소년, 여성 등에 그 한계를 두고 있음을 알 수 있다. 그리고 노인학대에 대한 개입방법이나 제도적 뒷받침이 부족했던 것이 사실이다. 따라서 노인학대에 대한 한국의 가족적 상황을 고려한 노인학대의 개념을 정의 하고 노인학대를 일으키는 다양한 요인 및 유형을 이론적 근거에 따라 분석하고, 노인학대에 대한 현행법상 처리절차를 살펴보고, 노인학대의 현황분석을 통한 노인학대의 형사정책적 대용방안을 모색하고자 한다.
무엇보다도 노인학대의 문제에 적절히 대처하기 위해서는 노인들이 사법 기관에 대하여 갖고 있는 신뢰를 고양시킬 필요가 있고, 노인들이 자신들의 권리 확보 및 피해구제에 대해서 정확한 판단을 하도록 담보해 출 수 있는 제도적 장치의 마련이 필요하다.
노인같은 소수자의 권리보호를 위해서는 그 소수자가 갖추지 못한 의사소통 구조를 복원시키려는 노력과 국민의 노인공경사상이 팽배해 있을때야만 진정한 소수자 보호가 이루어 질 것이다.

다국어 초록 (Multilingual Abstract)

Since July 2000, over 65-years old Korean elderly population has exceeded 7% of the total population. This means that Korea become an aging society under the UN standard. Studies show that by 2019, about 14 percent of the population will be seniors aged over 65. The increase of the aged population brings about the primary interest in the elderly abuse. Until now, the major issues of the criminology are concentrated in the adolescent, woman related crimes. Therefore, the strong interests of the aged abuse are lacked. The government should have been prepared institutional support and intervention for the aged mistreatment.
In this article, we tried to define the elderly abuse based upon the Korean traditional family band. We explored various factors of abasement and analyze types of mistreatment upon the theoretical ground. We proceeded to the current statutes regarding elderly abuse and argued the policy loopholes for the aged abuse. Finally, we attempt to analyze the present condition of the aged mistreatment cases in this piece and seek to counter plan to correct the aged abuse issues focusing on the criminal policy.
Above all things, in order to handle the aged abuse matter, confidence for the judicial government by the aged must be enhanced. We also find that the systemic or institutional grids are necessary for the remedies of the damaged the aged and they should have protect their legal right. For the protection of minority right, the restore of the communication channel that they have not equipped is needed and the respect the aged should have overflow in the society.
