According to a survey on the scale of platform workers in 2022, the number of platform workers has increased by about 20% to 30% or more compared to 2021. However, other studies on platform labor have shown that platform workers do not have contracts for their work and are subjected to unfair treatment, including human rights violations. Nevertheless, there are not enough mechanisms to respond to such unfair treatment, so platform workers are strongly demanding a dispute mediation and legal support system for unfair and unfair trade issues. Faced with this situation, this paper examined the types of disputes that may arise in the course of platform labor and studied the dispute resolution system for platform labor that should be explored based on this. In conclusion, this papre propose the followings.
First, effective measures are needed to ensure fairness and transparency in platform labor relations.
Second, platform operators should be obligated to establish an intra-company dispute resolution system to resolve disputes between platform operators and platform workers by first resolving disputes within the company, while institutionalizing guidelines on the specific contents and methods of the intra-company dispute resolution system.
Third, measures should be taken to allow for the optional or sequential use of extra-enterprise private mediation and extra-enterprise public mediation as extra-enterprise dispute resolution mechanisms to resolve disputes when intra-enterprise mediation fails.
Fourth, an administrative (quasi-judicial) platform labor relations mediation board, similar to the Network Worker Relations Board in New York State, should be established in addition to the internal and external mediation systems.
Fifth, legislative measures should be taken to effectively guarantee the labor rights of platform workers, as well as a review of the system for extending the effectiveness of collective agreement by industry.
Sixth, it is necessary to establish a worker status determination committee, either independently or within the platform labor relations conciliation committee proposed in the fourth proposal, so that disputes regarding the legal status of platform workers can be resolved quickly and effectively.
