반덤핑 제도의 역사적 고찰 및 제로잉(Zeroing) 분쟁 변화에 관한 연구 = A Study on the Anti-Dumping Policy and Zeroing Methodologies:Historical Review and Future Task

국문 초록 (Abstract)

한국과 같이 수출이 경제에 큰 부분을 차지하는 국가에서는 규범협상에 대한 이해가 중요하다. 세계에서 중국에 이어 두 번째로 빈번한 반덤핑 피제소국인 우리나라는 WTO/DDA 협상 출범 이후 대표적인 수입규제조치인 반덤핑 조치에 대한 규율을 강화하기 위해 노력해 왔고 그 중에서도 덤핑마진 계산과정에서 마진을 인위적으로 높이는 제로잉(Zeroing) 관행의 금지는 중요한 협상과제의 하나로 추진되어 왔다. 이러한 배경을 바탕으로 본고에서는 반덤핑 제도의 변화상과 제로잉 관행을 WTO제소 사례를 중심으로 살펴보았다.
1995년 우루과이 라운드 반덤핑협정 발효이후 모든 회원국들이 반덤핑조항에 구속되게 되어 반덤핑 입법이 크게 증가하였다. 반덤핑제도의 활용 변화는 선진국들의 경우 대상국가가 선진국에서 개도국으로 변화되었으며 개도국은 대상국가가 개도국에서 선진국으로 변화되었는데 이는 보복적 반덤핑규제를 해왔음을 알 수 있다. 이와 함께 개도국 간 무역량 증가에 따른 반덤핑제도 활용이 빈번해졌음을 또한 알 수 있다.
EC-Bed Linen 분쟁은 WTO 출범 이후 인도가 EC를 상대로 제소한 최초의 제로잉분쟁이라 할 수 있다. 이 사건에서 EC는 반덤핑 제도를 변경하고 더 이상 제로잉을 사용하지 않고 있다. 이후 US-Zeroing(EC), US-Zeroing(Japan) 두 사건에서 미국이 패함에 따라 제로잉 관행 시정 조치가 불가피한 상태가 되었다. 과거의 사례를 볼 때 제도를 개선하는데 수년이 걸리고 부분적인 개선에 머무르는 경우가 많아 지속적인 모니터링뿐만 아니라 표적덤핑과 관련된 조문을 삭제하기 위한 노력도 해야 한다.

다국어 초록 (Multilingual Abstract)

In recent years, the use of anti-dumping policy has grown significantly, and in fact has become one of the most important instruments of trade policy in many countries. Especially, it is very important to understand the international commerce law in case of Korea. Because export is the great part of the economy. This paper provides an overview of anti-dumping literature and understanding of zeroing methodologies through three cases taken the issue to the World Trade Organization(WTO).
From the 1980s, anti-dumping has been spreading worldwide in two dimension. On the one hand, the number of anti-dumping petitions has been growing in the so-called traditional users. On the other hand, more and more countries have adopted an anti-dumping law and many of them have followed the traditional users' example and started to rely strongly on this policy. The intensity in the use of anti-dumping clearly shows that the role of traditional users has dramatically decreased, while in recent years developing countries have surged to become the protagonists of anti-dumping procedures-with intensities much higher than the usual suspects.
The zeroing methodology, generally speaking, involves treating specific price comparison which do not show dumping as zero value in the calculation of a weighted average dumping margin. The WTO anti-dumping agreement contemplates three methodologies for calculating a dumping margin in investigations : average-to-average, transaction-to-transaction, and average-to-transaction. In addition to the question of the use of zeroing for each methodology, there is a question as to whether zeroing can be used in different types of anti-dumping proceedings, including investigations, administrative reviews and sunset reviews.
