Legislation and policy making for the protection of the rights of the prisoner and the resocialization of them are very tardy. Moreover, even the already enacted provisions are not abided by in practices. Considering a variety of institutions protecting the suspect, the accused and the criminal victim, it is reasonable to say that prisoners are under a unreasonably poor condition. According to ADMINISTRATION AND TREATMENT OF CORRECTIONAL INSTITUTION INMATES ACT, convicted prisoners shall be placed in solitary confinement and non-solitary confinement is to be exceptional. Nevertheless, the usual type of the confinement in practice is non-solitary, prisoners being exceptionally placed in solitary confinement only when it is needed. The lack of correctional facilities, national finance, and manpower makes non-solitary confinement common in the correctional institutions. The portion of solitary confinement amounts only about 3% of entire confinements. Even if a prisoner is placed in the solitary confinement, it is mostly for the purpose of safe guard. Under the overcrowded non-solitary confinement, prisoners enjoy little privacy and the places of confinement degenerate into place for learning the skills of new crimes amongst prisoners. This frustrating reality is harmful to the order in the correctional institution and incapacitates the ideology of resocialization. Compared to international rules and the laws of other nations, the current way of confinement is found to lag behind any other country. Overcrowded confinements should be reduced immediately. The size of space guaranteed to a prisoner should be legally prescribed in the short term and classified treatment is to be enforced thoroughly. Current provision that non-solitary confinement's standard is 3 people or more is meaningless to the protection of the prisoners' rights and fulfillment of correction. Furthermore, various community-based treatments need to be cultivated.
