노인학대 중 경제적 학대에 대한 고찰

국문 초록 (Abstract)

우리나라 노인복지법은 노인학대의 유형을 신체적, 정신적, 정서적, 성적폭력 및 경제적 착취, 가혹행위, 유기, 방임으로 구분하고 있다. 그러나 각 유형을 구분하여 학대를 예방하고 대응하는 방식을 취하고 있기 보다는 포괄적이고 종합적인 방향에서 노인학대에 대응하는 접근방식을 취하고 있다. 그에 따라 경제적 착취가 경제적 학대로 혼용되기도 한다. 경제적 학대는 노인복지법과 형법 외에 민법, 금융/경제 관련 법, 사회보장법 등 다양한 법의 영역이 적용된다. 따라서 현행법에 의존할 경우 사안에 따라 경제적 학대를 효과적으로 대응하기 어려운 구조적 문제가 있다. 또한 노인복지법상 경제적 학대에 대한 형량과 형법상 관련 규정의 형량이 달라 동일한 행위에 대해 노인복지법만을 적용할 때 오히려 감형이 가능한 경우도 발생한다. 특히 다른 학대유형과는 달리 단순히 가해자를 처벌하는 사후대응책 보다는 피해를 당한 노인이 민사소송이라는 사법절차를 거쳐 문제를 해결해야 하는 경우가 발생하는 등 노인이 대응해야 할 절차와 범위가 더 넓어질 수 있다. 경제적 학대의 심각성을 인식하고 노인이 지역사회 자원과 유기적 연결망을 구축할 수 있도록 관련 시스템을 구축할 필요가 있을 것이다.

다국어 초록 (Multilingual Abstract)

The Korean Elderly Welfare Act distinguishes the types of elder abuse as physical, mental, emotional, sexual violence and financial exploitation, harsh behavior, organic, and neglect. The act responds to elder abuse in a comprehensive and comprehensive direction. There is no detailed breakdown of abuse in each area. Thus, financial exploitation is often used in combination with financial abuse. In addition to the elderly welfare act, financial abuse includes various laws such as criminal law, civil law, and social security law and other acts. Therefore, there is a structural problem that it is difficult to effectively deal with financial abuse. In addition, the Elderly Welfare Act may cause a reduction in the amount of penalties for financial abuse compare to the penal provisions related to criminal law. Moreover, the victimized elderly often has to solve the problem through the judicial process of civil litigation. It is necessary to establish various systems to prevent the financial elder abuse effectively by forming the related system and help the elderly to build a strong network with the community resources.
