학력인정의 법체계와 법리의 검토 = Analysis on the legal issues of academic achievement accreditation

다국어 초록 (Multilingual Abstract)

This paper analyzed the legal issues of academic achievement accreditation. Firstly, the study explained that concept of academic achievement is multiple legally. The term is used indicate academic ability, academic achievement, school career, of academic qualification. This literature categorized the system of academic achievement accreditation in Korea. The first way is to accreditate academic achievement by attendance of regular school. The second way is by examination. The third way is by selection of facility or person. The study suggested that we should improve irrationality of selective accreditation by facility condition, consider recognizing academic curriculum for recognition of academic achievement, legalize the studying abroad by condition of completing minimum curriculum, change the necessary subjects and selective ones of examination, and recognize the qualification outside school as academic achievement.

국문 초록 (Abstract)

학제개편이나 학력인정방안에 대한 연구가 종종 이루어졌지만 학력인정의 법체계와 법리에 대해 다룬 연구는 많지 않았다. 이 연구에서는 학력인정에 관한 법체계와 법적 쟁점을 분석하였다. 먼저 학력의 개념이 법적으로 다중적임을 밝혔다. 또한 우리나라의 학력인정체제는 정규학교 출석에 의한 학력인정, 시험에 의한 학력인정, 선별인정에 의한 학력인정으로 구분됨을 밝혔다. 학력인정의 법리를 검토한 결과 교육공간에 따른 선별인정의 불합리성 개선, 교육과정 이수를 기준으로 한 학력인정, 학력인정 교육과정의 일관성확보, 학력인정 최소기준 이수를 전제로 한 외국유학의 합법화, 검정고시 필수-선택과목의 조정, 학교밖 자격 취득의 학력인정 요건화 등이 필요한 것으로 제안하였다.
