경호학 학문의 자유를 제한하는 대통령경호실법 규정 위헌성에 관한 연구 = A Study on the Unconstitutionality of the Presidential Security Law(PSL) Restricting Freedom of the Security Science

다국어 초록 (Multilingual Abstract)

This paper is to study the unconstitutionality of the Article 5-4-2 of the Presidential Security Law that "when a public service personnel(including the retired and the reemployed) announces matters related with the duty of the Presidential Security Service in the way of publication and so on, he or she has to be admitted by the section chief in advance.
At first, this paper describes the birth and the growth of the Security Science in Korea and the nature of freedom of study and expression based on the Constitution.
And the theory of the definiteness, the principle of the excess prohibition, the theory of the benefit and protection of the law and the discipline of the definite-existing danger are to be suggested as standards to judge the general legal reservation and the constitutionality.
Furthermore, according to opinions of scholars in the journalism and the constitution and the standard of Judgment, this paper reaches a conclusion that the Article 5-4-2 of the PSL is made in violation of the principle of the excess prohibition and the equality.
Thus, the Article 5-4-2 of the PSL restricting freedom of studies and expression in the Security Science has to be revised.
