地方議會制度의 問題點과 改善方案에 관한 硏究 = (A) Study on problems and improvements of local assembly

국문 초록 (Abstract)

세계화, 정보화, 그리고 지방화로 표현되는 21세기에 있어 우리의 지방의회는 발전과 퇴보의 가능성을 동시에 보이고 있다. 점차 심화되어 가는 분권화와 지방화가 지방의회의 기능과 위상을 더욱 더 강화해 갈 것으로 예상되므로 정보화와 세계화의 진전에 따른 지방의회가 발전하려면 기본적으로 주민에 보다 가까운 지방의회의 제도를 효율적인 개선방안을 통하여 민주적 제도로 자리잡아야 할 것이다. 그러므로 본 연구는 이러한 문제를 중점적으로 진단, 분석하고, 지방의회가 보다 긍정적인 기능과 함께 시대에 맞는 제도에 대한 개선방안은 다음과 같다.
첫째, 지방의원의 전문성 제고와 지방의원의 유급제, 선거구제 및 의원정수 조정이 있어야 한다. 지방의원의 전문성제고는 전문성과 정치력을 지닌 지방의원이 되어야 하는데, 이는 정치력 즉 타협능력과 중재능력이 있어야 다양한 형태의 토론을 할 수가 있으며, 또한 주민들의 의사를 정책에 반영하고 주민의 요구에 의해 정책을 감시하는 기능을 끊임없이 수행하기 위한 지방의원의 자기개발이 필수적이다. 그리고 지방의원의 유급제를 통한 신분상승으로 보다 적극적인 자세와 창의성을 유도할 수 있으며, 지방의원 선거구제 및 의원정수 조정으로 지방의회를 활성화하여야 한다.
둘째, 지방의회 의장단 선거를 둘러싼 갈등을 해결하기 위해서는 의장을 비롯한 간부자리의 매력을 줄이고, 주민을 위해 열심히 일하는 의원을 언론 등에 홍보를 강화하여 열린 의정을 구현하고 돈·권한·명예의 분리와 의원을 명예와 존경으로 보상해야 할 것이다.
셋째, 지방의회 위원회 활성화 방안으로는 지방의원 보좌관제 도입, 전문위원회 인력확충과 직급상향조정, 인사권 독립, 집행기관·상임위원회간 협의체제 구축으로 의원들의 의정활동을 지원하여 지방의회 위원회 활성화를 토대로 지방의회를 조기에 정착시켜야 할 것이다.
넷째, 지방의회 사무기구의 효율적 운영을 위한 방안으로는 의회직의 신설과 인사권 독립, 의회사무기구의 내부조직 및 인원조정, 전문위원수와 직급 적정성을 통하여 지방의회 사무기구를 자주성과 독립성 보장으로 지방의회 사무기구를 자율적으로 운영하여야 할 것이다.
지방자치는 제도의 도입만으로 완성되는 것이 아니므로 지방자치는 정치참여와 제도화의 간격을 꾸준히 줄여 나가는 노력을 통해서만 정착될 수 있다. 그러므로 지방의회 의원은 의정활동을 함에 있어 더욱 전문화하려는 노력이 필요하고 지역주민은 지방의회에 대한 관심과 애정을 가져야 한다. 또한 여러 가지 제약적인 법적 권한으로부터 실질적인 의정활동이 이루어질 수 있도록 포괄적인 지방자치법의 개정이 필요하며, 지방자치의 중추적 기본요소인 지방의회를 구성하여 지방자치 수행에 견제와 균형을 유지하는 메커니즘 도입으로 지방의 정치와 행정이 한단계 원숙함을 이루고, 주민들은 급격한 사회변동의 흐름속에 주민생활 환경의 악화를 막고, 주민자신이 민주국가의 주인공다운 자세를 갖게 되어 주민에 의한 행정으로의 전환이 되는 계기를 마련하여 앞으로 보다 더 민주주의의 기본정신에 따른 지방의회를 발전시켜야 할 것이다.

다국어 초록 (Multilingual Abstract)

The assembly in Korea has the possibility of development and retrogression simultaneously in the twenty first century represented as internationalization and localization, as well as information-based society. Since decentralization and localization are being deepened, the function and position of local assembly are expected to be strengthened. However, improvement of its system, which considers local residents, should be accompanied for its development. Therefore, this study analyzes these problems, and positive function of local assembly, and the method for up-to-date function.
First, specialization improvement of members of local assembly and its paid post, adjustment of constituency system and the number of its member should be done. The member must have specialty and governing ability because they are expected to have abilities of compromise and arbitration and to have diverse discussion skills, and are required self-development to fulfill politic function continuously. In addition, throughout the its paid post as well as adjustment of constituency system and the number of its member, which will lead more active attitude and originality from the member, local assembly should be activated.
Second, to solve the discord resulting in election of local assembly chairman, advantages of chairman and the governing body should be curtailed, and excellent members who work for local residents should be publicized for open assembly. Money, authority, and honor should be separated and the member should be respected as compensation.
Third, to activate its committee the following should be accomplished: introduction of assistant system, expansion of professional personnel, upturn of their position, independence of personnel management, establishment of cooperation system between executive organ and standing committee. Then, the member will be supported doing their assembly work and local assembly system will be rooted at an early stage.
Forth, to manage business organization effectively, opening new positions, independence of personnel management, as well as adjustment of internal organization, of personnel, of the number of specialized member and their proper position should be fulfilled, and independence and self-reliance of business organization should be guaranteed for self-operation.
Local government takes root by not only the introduction of its system, but also the effort to narrow the gap between participation and system. Most of all, local assembly, the core of local government, should be organized and introduced a mechanism to maintain check and balance in the matter of performing self government. By doing so, local politics and administration mature and local residents prohibit any further life degeneration resulting in dramatic social changes. Therefore, they will be prepared as the host of democracy and which takes opportunity to become administration for local residents. As doing so, local assembly will be developed based on fundamental idea of democracy.
