Analysis of China’s Policy toward North Korean Defectors

국문 초록 (Abstract)

탈북자 문제는 지난 수년 이래 남북한과 중국 간 심각한 정치문제로까지 진전되고 있다. 이는 정치적, 경제적, 국제법적 그리고 인도적 문제로서 동북아 지역에서는 전례가 없을 뿐 아니라 다른 지역에서도 흔히 경험했던 것이 아니다. 따라서 쉽게 실마리가 잡히지 않고 있는 실정이다. 국내외 연구 결과에 의하면 탈북자의 대부분이 중국 동북 3성지역에 체류하고 있으며, 최근 들어 중국 내지와 몽골 및 동남아 등으로 확산되고 있는 양산이다. 중국 정부는 초기 탈북자 문제를 심각하게 생각하지 않았으나 2000년대 초반재중 탈북자들의 외교공관 진입사건이 연쇄적으로 발생, 하나의 경향으로 나타나면서 위 문제가 국제적 이슈로 부각됨과 동시에 관련국가간 외교문제로 불거지는 등 중국에 적지 않은 부담으로 작용하게 되었다. 탈북자 문제는 북한을 둘러싼 문제들 중 가장 현실적이고 특히 관련 당사국 중 중국의 역할이 가장 중요함에 불구, 문제를 키우고 싶어하지 않는 중국은 그 동안 소극적인 자세로 일관해 왔다. 본 논문에서는 중국의 탈북자 인식 및 관련 정책에 대해 자세히 분석해 보고자 한다. 중국은 탈북자를 불법경제이민자로 규정하고 있으며, 북중 간 맺은 양자협정에 의해 탈북자를 송환하는 정책을 실시하고 있다. 중국은 이와 같은 기본 입장에는 변화가 없으나, 여러 요소들로 인해 정책의 집행방식에 불일치를 보여 왔다. 현재까지의 탈북자 정책을 살펴본 결과 국내적 요인, 북중관계 그리고 외부적 요인 세 가지가 정책결정에 주된 요인으로 작용하였으며, 중국의 탈북자 정책이 주는 의미를 여러 각도로 설명하였다. 마지막으로 탈북자 문제와 관련, 그 동안 난민지위의 획득과 탈북자의 인권을 옹호하는 방식으로 접근해 온 한국정부와 관련기구에 정책제안을 하였다.

The problem of North Korean defectors in recent years has evolved into a serious political issue among North Korea, South Korea, and China. As an issue with implications in political, economic, legal, and humanitarian realms, it is not only without precedent in the Northeast Asia region, but also rare in other areas of the world. Even knowing where to begin seeking for solutions has proved problematic. According to research from both South Korea and abroad, most defectors from North Korea reside in the Northeast regions of China, and in recent years have spread to interior parts of China, Mongolia, and Southeast Asia. At first, the Chinese government did not take seriously the problem of North Korean defectors, but were forced to address the issue in the early 2000s. There were several cases of defectors storming diplomatic offices, putting the international spotlight on China and putting Beijing in diplomatic hot waters. Although the problem of North Korean defectors has the most visible consequences in the real world, and is an issue in which China’s policy weighs the most heavily, the Chinese government has continually demonstrated a passive stance on the issue. This research aims to critically examine the way China views North Korean who cross into China as well as its North Korean defector policy. China currently considers defectors as illegal economic migrants, and repatriates defectors according to a bilateral agreement concluded between China and North Korea. Although China has not significantly deviated from this policy line, several factors and changes have resulted in an inconsistent implementation of this policy. This paper examines the domestic situation, Sino-North Korean relations, and external variables as the determining factors of China’s policy toward North Korean defectors, and the various insights they offer into the policy decision making process. Lastly, this research offers policy proposals on the part of the South Korean government and related organizations.
