지방분권론과 지역사회복지의 전망- 지방자치법과 사회복지법을 중심으로 - = The Theories of Decentralization and the Future of Community Welfare : By the acts of local government and social welfare

다국어 초록 (Multilingual Abstract)

The Decentralization in the sphere of social welfare implies that the responsibility of state for the welfare can be imputed to local government. And the chiefs of local governments have so much discretions in implementing social welfare services in law. Therefore, it can be only favorable but also unfavorable to community welfare. But every social welfare law impose authorities of controlling local government on central one against act of local autonomy. In fact, therefore, the development of community welfare is dependant upon the willingness and competence of central government in spite of the idea of decentralization and local autonomy.
Very recently, the revised law of social services passed in National Assembly. Local governments have to plan community social welfare through the consultation of community social welfare council according to the law. And also, every community resident have a right to request for socal welfare services to local government. It is a clue to community socal welfare in the age of decentralization.
It still remain some tasks. First, central government has to be financially responsible for community welfare because of poor local governments. Secondly, all laws of socal welfare services must be revised and coordinated for the idea of community social welfare and decentralization.

국문 초록 (Abstract)

우리나라에서 지방자치는 신자유주의적 경향과 함께 해온 측면이 있다. 따라서 사회복지정책의 측면에서 지방분권론은 사회복지에 대한 국가책임의 지방화를 의미하며 복지책임에 대한 지방분담론으로 볼 수 있다. 또한 사회복지서비스법에서는 지방자치단체 및 단체장의 역할과 책임에 대하여 임의규정 형태로 재량권을 부여한 것이 일반적이어서 조건에 따라 지역사회복지가 향상될 수도 있고 침체될 수도 있다. 그러나 대부분 이에 필요한 기준, 절차, 조건 등은 시행령이나 시행규칙에 위임되어 있어서 지방자치단체의 지역사회복지에 대한 노력은 여전히 중앙정부의 통제하에 놓여 있다고 볼 수 있다. 지역사회복지가 증진되기 위해서는 지방자치단체에게 사회복지에 대한 책임을 강화하고 독자적으로 사회복지서비스를 제공할 수 있도록 지방분담의 원칙을 명확히 해야 할 것이다. 동시에 재정자립도가 낮은 지방자치단체에 대해서는 지역균형발전의 차원에서 정부의 교부금을 인상하고 각종 시설 및 인력 확충에 특별 지원을 해야 할 것이다. 이것이 지방분권체제 속에서 사회복지에 대한 국가의 책임을 구현하는 하나의 방법이 될 것이다.
