지방자치단체의 국제협력 = International cooperation of Local Government

국문 초록 (Abstract)

지방자치단체의 국제협력은 지방분권과 세계화현상을 누구나 언급하게 된 20세기 마지막 시점부터 본격적인 논의를 하게 된 비교적 새로운 분야이다. 국제교류의 확대와 국제협력 주체로서 지방자치단체의 등장은 우리만의 상황은 아니고 서유럽에서 시작된 분권적 협력을 통한 지역개발 당사자로서 지방자치단체의 역할의 확대와 지역경쟁력이 국가의 가용능력이 된 시대적 흐름과도 더 직접적으로 관련된다. 본고에서는 그간 산발적으로 이루어진 지방자치단체의 대외적 협력과 교류에 관한 선행연구를 통해 지방자치단체의 대외활동의 논리적 배경을 검토해보고 지방자치단체의 국제교류와 협력활동에 관한 다양한 형태에 대해 알아보았다. 지방자치단체가 국경을 넘어 자신의 공적 활동의 범위를 넓히는 것은 전통적인 국내법 질서의 관점에서 본다면 치외법권(l’extraterriorialité)의 영역으로 개입하는 것을 의미한다. 세계화의 흐름은 경제뿐만 아니라 법적 분야에서도 영향을 받고 있으며 국경을 넘는 지방자치단체의 해외협력 활동은 전통적인 국제교류의 모습인 자매결연과 우호교류를 넘어서 공적개발원조에서 국가의 보조자의 위치에서 자주적인 역량을 넓혀가고 있다. 지방자치단체의 교류협력은 자매결연과 우호협력으로 대표되며 1961년 진주시와 미국 오레곤주 유진시의 자매결연 이후 현재는 82개국 1,249개 도시 1,659건이 체결되었다. 그리고 지방자치단체는 국제개발협력기본법과 공공외교법 등에 다라공적개방원조 사업의 주요한 행위자로 활동하고 있다. 다만 법제도상으로 상기 법률과 지방자치법 등 제반 법률에 의한 권한의 소재와 국가의 감독에 관한 논의가 제기되고 있으며 이에 대한 법제정비가 필요하다.

다국어 초록 (Multilingual Abstract)

The international cooperation of local governments is a relatively new area that has been in full-fledged discussions since the last part of the 20th century. The expansion of international exchanges and the emergence of local governments as the main actor of international cooperation are not just our situation, but more directly related to the expanding role of local governments as parties to regional development through decentralized cooperation that began in Western Europe and the trend of the times in which regional competitiveness has become the nation s available capacity. Through a prior study on the external cooperation and exchanges of local governments, which has been sporadic, we reviewed the logical background of local governments external activities and looked into various forms of international exchanges and cooperative activities. The expansion of the scope of local government’s public activities across the border means intervening in the realm of extraterritoriality, if viewed from the perspective of traditional domestic legal order. The trend of globalization is influenced not only by the economy but also by the legal sector, and the local government s extra activities across the border are expanding its independent capacity in the position of the country s assistant in public development aid beyond sisterhood and friendly exchanges, the sun of traditional international exchanges. The exchange and cooperation of local governments is represented by sisterhood ties and friendly cooperation, and 1,659 cases by 1,249 cities in 82 countries have been signed since the sisterhood ties between Jinju City and Eugene City, Oregon, in 1961. In addition, local governments are acting as major actors in public opening aid projects in accordance with the Framework Act on International Development Cooperation and the Public Diploma9cy Act. However, due to the legal system, discussions on the location of the authority under the above laws and local autonomy laws and the supervision of the state are being raised, and legislative readjustment is needed.
