국제법상 ‘형평’(Equity)개념에 대한 ‘실증주의적’ 고찰

국문 초록 (Abstract)

국제법상 형평은 실정법 적용의 결과에 대한 교정의 역할이 아닌 구체적인 사건에서의 개별적 정의를 실현하는 기능을 하고 있다. 다만 이러한 형평은 국제법의 전 분과에서 사용될 수 있는 개념이 아니다. 오로지 형평이 조약상의 규정 또는 국제관습법에 포함되어 있을 때에만 원용될 수 있을 것이다. 그리고 이와 같이 형평을 원용하는 국제법의 영역은 한정되어 있다.
따라서 기존에 존재하던 형평의 세 가지 기능에 대하여 국제법의 맥락에서 논의를 전개하는 것 또는 배분적 정의를 실현하는 수단으로 형평을 제시하는 것 등은 사실 판례 및 실정법에 근거한 논지가 아니다. 더구나 개별 사건에서 유연하게 적용되는 형평을 눈에 보이는 실체로 간주하기 위해 객관적 형평 개념을 동원하는 것 또한 판례 및 실정법에서 지지될 수 없다.
오로지 국제법상 형평 개념은 형평 개념이 포함된 관련 조약상의 규정 또는 국제관습법을 통해서만 적용될 수 있다. 이러한 적용의 예는 국제하천의 사용과 관련한 형평한 이용, 해양경계획정에서의 형평한 해결, 공해상에서의 어업과 관련된 형평한 분배 등이다. 이러한 영역에서 형평이 적용되고 있는 이유는 형평한 결과의 도달이라는 목적이 규범화되어 있기 때문이다. 그리고 이와 같은 목적을 달성하기 위해 관련 요소들 또는 관련 사정들을 고려하여 이들의 균형(balancing)을 세우는 것이 개별적 정의를 실현하기 위해 형평을 적용하는 방법일 것이다. 따라서 관련 요소들 또는 관련 사정들과 같은 사실(fact)의 도출과 이에 대한 고려가 실정법 ‘내’에 존재하는 형평 개념을 통해 이루어지고 있는 것이다.
결국 국제법상 형평 개념은 국제법의 몇몇 한정적인 영역에서만 규범화되어 있는 실체이고, 그 영역에 한해서만 형평은 주도적인 역할을 하고 있는 것이다.

다국어 초록 (Multilingual Abstract)

The role of equity in international law is not to correct existing law, but to attain individual justice in a specific case. However, equity cannot be employed in all the areas of international law. It is only when a specific treaty or relevant customary international law includes the concept of equity that equity should be considered. In addition, there are only a limited number of branches of international law in which equity can be applied.
The general argument that there are the three functions of equity in international law or that equity should be regarded as a way of bringing about distributive justice can hardly be justified as being based upon treaties (and customary international law) or case-law. Likewise, it is difficult to support the concept of the so-called ‘objective’ equity, which is an effort to make equity more perceptible, because it is not found in treaties (and customary international law) or case-law.
Equity in international law can be employed only when a specific treaty or relevant customary international law implies the application of equity: the concept of an equitable utilization in the law of international watercourses, the concept of an equitable solution in the law of maritime boundary delimitation, and the concept of an equitable allocation in the law of high sea fisheries. The reason for utilizing equity in only a few areas of international law is that the aim to reach an equitable ‘result’ is legally binding as far as certain areas of international law are concerned. In order to achieve the aim, relevant factors or circumstances should be balanced. In other words, when the concept of equity itself exists ‘within’ a specific treaty or relevant customary international law, then the process of identifying and considering the facts (that is, relevant factors or circumstances) brings about individual justice in a particular case.
In sum, equity in international law is a unique subject found in a limited number of branches of international law, and it plays a key role in achieving an equitable result only in a small number of areas of international law.
