헤겔 청년기 정치철학에서 권력국가의 이념 = The idea of a power state in Hegel’s Youth political philosophy

국문 초록 (Abstract)

본 연구는 헤겔 청년기 정치철학에서 나타난 권력국가의 이념을 해명하고 그 정치철학적 의의를 구명하는 작업이다. 헤겔 청년기의 정치철학 저작들 중 권력국가의 이념이 전형적으로 드러난 저작은 『독일의 헌법』과 『자연법』이었기 때문에, 본 연구에서는 이 두 저작에 대한 분석에 집중하였다. 먼저, 『독일의 헌법』에 대한 고찰에서는 권력국가의 이념 형성의 배경이 된 독일의 역사적 상황에 대한 헤겔의 비판적 분석과 그 의의를 해명하였다. 이에 따를 때, 헤겔은 독일이 단일 국가를 이루지 못하고 여러 란트들로 분열되어 있었던 데에 대한 근거를 ‘독일적 자유’ 혹은 ‘독일적 성격의 완고함’으로 보면서, 국가 내 여러 부문들이 독자적인 권리와 권력을 형성하는 것을 억제함으로써만 단일 국가를 형성할 수 있다고 하는 권력국가의 이념을 제시했다. 이때 헤겔이 구상한 권력국가의 구체적인 의미는 정치권력이나 군사력과 같이 실질적이고도 현실적인 힘과 권력을 통해 성립하고 유지되는 단일 국가를 가리킨다. 다음으로, 『자연법』에 대한 고찰에서는 ‘인륜적인 것에서의 비극’이라는 표현에서 드러난 헤겔의 비극적 역사의식의 정치철학적 의의를 해명하였다. 이에 따를 때, 헤겔은 고대부터 근대까지의 서구 역사는 인륜적 공동체의 공적 의식을 상실하고 개인의 주관적 권리 의식이 확대되어가는 ‘주관화’의 과정을 밟고 있는 것으로 해석하면서, 이를 국가권력을 통해 ‘분리’ 혹은 ‘제압’함으로 써만 ‘절대적 인륜성’을 구제할 수 있다고 생각했다. 마지막으로, 청년기 헤겔의 국가론이 지니는 정치철학적 한계점에서 대해서 비판적으로 분석하였다. 이에 따를 때, 헤겔은 일종의 역사적 필연성이 된 근대사회의 주관성의 계기를 단순히 제압함으로써는 온전한 근대국가를 이룰 수 없다는 인식 하에 『법철학』에서는 국가권력과 개인의 권리 보장이 유기적으로 조화를 이룬 새로운 근대국가의 이념을 기획하기에 이르렀다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to clarify the idea of a power state in Hegel’s Youth political philosophy and to find out its politico-philosophical significance. In this study, I focused on the analysis of the German Constitution and the Natural Law because these books typically represent the idea of a power state among Hegel’s Youth political philosophy books. First, in the analysis of the German Constitution I clarified Hegel’s critical analysis and its significance of the historical situations in Germany that were the background for the formation of the idea of a power state. The results of this analysis are as follows: Hegel viewed the reason why Germany was divided into several Lands without forming a single state as “German liberty” or “German stubbornness of character”, and he suggested the idea of a power state that a power state could be formed only by restraining the formation of independent rights and powers of the various sectors in the state. And the concrete meaning of a power state envisioned by Hegel in the German Constitution refers to a single state established and maintained through actual and realistic power, such as political and military power. Second, in the analysis of the Natural Law, I elucidated the politico-philosophical significance of Hegel’s tragic historical consciousness which is exposed in the expression ‘tragedy in the ethical life’. The results of this analysis are as follows: Hegel interpreted Western history from ancient times to modern times as undergoing a process of “subjectification” in which the public consciousness in the ethical community was lost and the consciousness of the individual subjective rights was expanded, and he thought that the “absolute ethical life” could be saved only by “separating” them from itself or “suppressing” them through a state power. Finally, I critically analyzed the politico-philosophical limitations of Hegel’s state theory in his Youth. The results of this analysis are as follows: Hegel came to plan the new idea of a modern state in which state power and individual subjective rights are organically harmonized in his book Law Philosophy, because he recognized that a modern state could not be achieved simply by suppressing the subjectivity of modern society which became a historical necessity.
