표현의 자유의 구조와 성격에 관한 연구 : 오프라인과 온라인상 실현방식에 대한 비교를 중심으로 = A Study on the Structure and Character of Freedom of Expression - on comparisons between offline and online

국문 초록 (Abstract)

현대사회에서 정보의 의미와 중요성은 점점 더 증대되고 있다. 이와 더불어 언론자유의 의미와 비중 또한 과거의 어느 때와 비교할 수 없을 만큼 높게 평가되고 있다. 특히 인터넷의 등장과 이를 활용한 다양한 온라인 의사소통방식의 발달은 기존의 의사소통구조에 혁신적 변화를 가져왔다. 이는 오프라인상의 언론자유와 온라인상의 언론자유가 과연 어떤 관계 속에 있는지에 대한 논란을 낳고 있다.
언론의 자유에 대한 전통적 이해가 오프라인에서의 의사소통을 전제로 구성된 것인 만큼 온라인상의 언론자유는 별개의 기본권으로서 그 성격 및 보호범위, 보호의 방식 등이 새롭게 이해되어야 한다는 주장이 있다. 반면에, 인쇄매체를 중심으로 발전되어 왔던 의사소통구조가 방송매체의 등장으로 큰 변화를 겪었지만 언론자유의 기본적 성격과 실현구조는 달라지지 않았다는 점을 강조하면서, 오프라인상의 언론자유와 온라인상의 언론자유는 본질적으로 다르지 않다고 보는 견해도 있다.
이러한 견해의 대립은 온라인을 이용한 의사소통이 활발해지면서 오프라인에서는 금지되는 행위가 온라인에서는 허용될 수 있는지와 관련하여 다양한 문제와 연결되고 있다. 예컨대, 오프라인에서의 표현물과 온라인에서의 댓글(이른바 악성댓글)에 대하여 명예훼손이나 모욕을 인정하기 위한 기준이 서로 다른지, 국가보안법상의 이적표현 및 고무·찬양의 판단기준이 오프라인의 경우와 온라인의 경우가 다른지, 오프라인상 사전선거운동은 금지되지만 온라인상의 사전선거운동은 허용되는 것이 과연 정당한지 등의 문제는 이러한 인식의 차이에서 비롯된 것이라 할 수 있는 것이다.
이 논문에서는 이러한 문제들에 대한 심층적 접근을 위한 전제로서, 표현의 자유의 구조와 성격을 오프라인과 온라인을 비교하여 검토하였다. 이를 위하여 먼저 표현의 자유의 발전과정과 이를 통해 형성·변화된 표현의 자유의 구조 및 성격(Ⅱ)에 대하여 먼저 정리하였다. 그 바탕 위에서 오프라인상의 표현의 자유의 실현방식(Ⅲ)을 고찰하고, 온라인상의 표현의 자유의 성격과 인정범위(Ⅳ)에 관한 논의를 개관하며, 이를 통해 오프라인과 온라인의 구조적 특성이 표현의 자유의 실현방식에 어떤 영향을 미치는지(Ⅴ)를 분석함으로써 이 논문을 마무리하였다.

다국어 초록 (Multilingual Abstract)

In modern society, with a rise of the meaning and significance of information, the value of freedom of speech has increasingly gained importance. In particular, the introduction of the Internet has led to the development of online communication, which has brought innovative changes in the existing communication structure. Under these circumstances, differing opinions on the relations between online and offline freedom of speech have been offered.
Because the meaning of freedom of speech has traditionally focused on offline communication, some insist that with an online exchange of ideas, freedom should be treated as a different human right in terms of its characteristics and range. As such, some feel that distinct means should be used in the protection of online freedom of speech.
In contrast, although the communication structure developed around printed media has been recently influenced by the introduction of the Internet, some say that the fundamental concept of freedom of speech and how to realize it has not changed. This view suggests that there is no difference between online and offline communication.
This clash of opinions about offline and online matters has led to numerous questions. For example, there is the issue of whether some forbidden offline behavior could be permitted online, as online communication prevails in our life. Specific areas of concerns include: 1) standards of judging defamation or insults; 2) acts benefiting, encouraging or praising an enemy described in the National Security Law; and 3) the banning of premature election campaigns.
As the premise for in-depth approach, this article considers structure and character of freedom of expression by comparing offline with online. Today, freedom of speech can be comprehended by the protection of entire communication’s structure including freedom of expression, right-to-know, and freedom of the press. However, this article is confined to freedom of expression in narrow sense except right-to-know and freedom of the press, because the discussion about a comparison between offline and online as stated above has been centered on freedom of expression.
For the discussion, how freedom of expression progresses, how it is formed, and how it is changed are examined first. Based on that, this article considers how it can be realized in offline. Also, this article obtains an overview on character and limit of freedom of expression, and ends by analyzing how the structural character in offline and online affects realization of freedom of expression.
