장애와 유전자 검사: 자기결정권의 함의를 중심으로 = Genetic Test Related to Disability And the Implication of the Right to Self Determination

국문 초록 (Abstract)

본 논문은 장애나 질병과 관련된 유전자 검사와 자기결정권의 일반적 쟁점들을 파악하고, 유전자 검사 시에 자기결정권 함양을 위해 고려해야 할 사항을 제시하고자 한다. 첫째, 장애에 대한 의료적 모델, 사회적 모델, 복합적 체화 이론을 소개한다. 둘째, 임신과 출산의 과정에서 관례적으로 행하는 유전자 검사가 장애인에 대한 사회적 편견과 차별적 태도를 함축할 수 있으며 이로 인해 임산부의 자기결정권이 제한될 위험이 있음을 주장한다. 셋째, 장애가 있는 사람에 대한 사회적 차별과 낙인찍기를 극복하는 방법으로서 인간의 취약성을 존중하고 개인의 서사를 통한 삶의 고유함을 존중하기를 제안한다. 특히 ‘장애 유무’에 따른 단순 규정에서 벗어나, 고유한 욕구와 선호 및 가치를 갖고 살아가는 개인의 서사성에 주목하며 개인의 통합성과 온전함을 존중하기를 주장한다.

다국어 초록 (Multilingual Abstract)

This paper deals with issues related to the right of self determination and genetic test. First, it introduces medical model of disability, social model of disability, and complex embodiment theory. Second, it argues that abuse of genetic testing along the pregnancy implies discrimination and stereotyping of the person with disability and does not promote the right of self determination of pregnant woman. Third, it emphasizes the respect of human vulnerability and proposes the narrative as the method to overcome social discrimination and stereotyping of the person with disability.
