전통문화향유권과 생활예술- 풍물을 중심으로 - = The Right to Enjoy Traditional Culture and Living Art

국문 초록 (Abstract)

｢문화예술진흥법｣ 등에서 문화를 장려와 시혜의 대상으로 삼았던 것과 달리 2014년에 제정된 ｢문화기본법｣은 문화를 향유하는 것이 인권(문화권)이라고 규정(제4조)하고 있다. 이는 우리 헌법이 문화국가의 원리를 헌법의 주요한 원리 중의 하나로 채택하고 있는 것에 부응하는 진일보이다. 하지만 우리 문화의 정체성과 미래를 선도할 전통문화의계승과 발전을 규정한 우리 헌법(제9조)의 정신에도 불구하고 각종 전통문화예술진흥법안들은 7전8기 끝에 ｢국악진흥법｣으로 이름을 바꾸고 국악진흥위원회가 빠지는 등 왜소화된 모습으로 2023년 제정되어 2024년 7월 시행을 앞두고 있다.
｢국악진흥법｣이 국악‘인’진흥법 또는 국악‘원’진흥법이 되지 않고 전통문화예술진흥법으로서의 진면목을 보이기 위해서는 국악 향유문화의 활성화(｢국악진흥법｣ 제9조)가 관건이다. 이를 위해서는 종래의 서양문화 중심, 문화감상권 중심의 문화예술진흥정책에서진일보하여 전통문화예술과 문화향유권에 방점이 놓여지거나 잠정적인 우대조치가 필요하다. 전통문화예술에 대한 잠정적 우대조치를 하는 경우에도 전문 전통예술가의 활동활성화와 전통예술 동호회의 활성화가 동시에 추구되어야 하며, 행정관료에 의한 진흥행정에 더하여 문화매개자와 같은 반관반민 전통예술인에 의한 촉진자가 촉매역할을 하여야 전통문화의 저변을 생활문화까지 넓힐 수 있다.
전통문화예술 진흥을 위한 첫 출발은 학교문화예술교육에 있어서 전통문화예술교육의확대 및 실질화와 연결되어야 한다. 나아가 전문 전통예술가의 창작공간과 전통예술 동호인의 교육공간이 융합하는 등의 전통문화예술 진흥을 위한 공간지원의 시야의 확대가필요하다. 또한 이른바 K-Culture진흥을 위해 유형문화재 중심의 문화재 인식에서 벗어나 무형문화재에 대한 조직과 예산의 확대가 절실하며, 문화예술진흥기금의 활용도 이제그 총량을 늘임과 동시에 전통문화예술지원에 보다 많은 할애를 해야 한다.｢문화유산법｣ 과 ｢공연법｣의 운용에 있어서도 전통문화예술 향유에 대한 정책적 행정이 필요하며, 생활예술 동아리활동에 대한 진흥책도 ｢스포츠클럽법｣에 따른 생활체육 동호회 수준으로확대되어야 한다.
생활예술향유자의 관점에서는, 이상과 같은 내용을 담아, ｢국악진흥법｣과 그 시행령이명실상부한 전통예술진흥법으로 업그레이드되거나 생활예술진흥을 도모하는 내용이 풍부하게 담기어야 한다고 생각한다. ｢지역문화진흥법｣, ｢공연법｣ 등 전통예술 진흥과 실질적 관련이 있는 다른 법률들도 성과지표위주의 관료적 지원 등에서 탈피하여 활동지원에 방점을 두는 등 운용면에서의 업그레이드가 필요하다.

The Basic Act on Culture, enacted in 2014, stipulates that enjoying culture is a human right. The Korean Traditional Music Promotion Act was enacted in 2023 and is scheduled to go into effect in 2024. This is a step forward in response to the fact that the Korean Constitution adopts the principle of a cultural nation as one of its main principles.
In order for the Korean Music Promotion Act to not become the Korean Traditional Music Personnel Promotion Act or the Korean Traditional Music Center Promotion Act, the culture of enjoying Korean traditional music must be revitalized. and Preferential treatment is needed for professional traditional artists and traditional art enthusiasts as part of affirmative action.
In order to expand the base of traditional living arts, not only promotion measures by administrative officials but also promotion policies such as cultural mediators must be pursued. The promotion of traditional arts must be linked to the expansion and substantiation of traditional cultural arts education in schools. There is a need to expand the scope of space support, such as converging the creative space of traditional cultural artists and the educational space of traditional art enthusiasts. In order to promote K Culture, it is urgent to move away from the recognition of cultural assets centered on tangible cultural assets and expand the organization and budget for intangible cultural assets. In addition, the total amount of the culture and arts promotion fund should be increased, and more should be devoted to supporting traditional culture and arts.
From the perspective of those who enjoy living arts, I believe that the above-mentioned contents should be included in the Korean Traditional Music Promotion Act or its enforcement ordinance, and I think that the Local Culture Promotion Act and Performance Act also need to be upgraded in terms of content and operation.
