‘내적 관점’의 중층 구조 = The Multilayered Structure of ‘the Internal Point of View’

국문 초록 (Abstract)

하트의 법이론에서 중요한 위치를 차지하는 ‘내적 관점’의 중층 구조를 분석함으로써 내적 관점을 구성하는 복합적 요소와 법적 실천의 맥락에서 내적 관점의 역할에 관해서 검토하였다. 우선 법적 실천에 있어서 참여자는 내적 관점을 가지기 위해서 법규칙의 내용을 이해할 수 있는 분석적·실천적 능력, 법규칙을 행위 규범적 이유로 받아들이는 특별한 동기를 가지고 있어야 한다. 그리고 법규칙이 사회적 사실로서 존재하기 위해서는 이와 같은 내적 관점이 널리 공유되어야 한다. 그런데 법규칙을 타인뿐만 아니라 자신의 규범적 기준으로 수용한다는 의미에서의 내적 관점은 일반적인 법체계가 존재하기 위한 개념적 필요조건이라기보다는 ‘건전하고 효과적인’ 법체계가 존재하기 위한 경험적 가설이라고 할 수 있다. 내적 관점의 경험적 구조는 규칙이 일반적으로 준수된다는 경험적 기대와 집단의 일반적 준수를 규칙 수용 이유의 일부로 삼는 규범적 기대로 구성된다. 법공직자들이 경험적 기대와 규범적 기대의 결합으로서의 내적 관점을 가지고 있는 법체계는 권위주의적 정권에 비해서 강력한 제재 및 정보통제 체계 없이도 그 법체계가 효과적으로 작동할 것이다.

다국어 초록 (Multilingual Abstract)

By analyzing the multilayered structure of the internal point of view(hereinafter “IPOV”), which plays a key role in H.L.A. Hart's legal theory, I examined multiple factors that comprise IPOV and its roles in the context of legal practice. First, in legal practice, a participant should have analytical and practical competence to understand the internal aspects of legal rules in order to have IPOV. Second, she should have distinctive motivations to accept legal rules as normative standards of her conducts. Third, for legal rules to exist as social facts, IPOV should be shared among participants. However, IPOV requiring both of enforcement sense and compliance sense can be understood as a kind of empirical condition of the existence of a “sound and effective” legal system rather than a conceptual prerequisite for the existence of a mere legal system. The empirical structure of IPOV consists of the empirical expectations that the rules are generally followed, and the normative expectations that collective compliance is considered as a part of reasons to accept the rules. In a legal community where its legal officials possess IPOV as a combination of empirical and normative expectations, their legal system will work more effectively without strong sanction and information control systems compared to an authoritarian regime.
