형벌강화 요구에 대한 심리학적 고찰 - 정의감과 응보욕구에 대한 사회심리학적 관점에서 -

국문 초록 (Abstract)

우리 사회 전반에 대한 불공정 인식이 매우 높은 수준으로 나타나고 있으며, 그 배경에는 입법과 사법 시스템 전반에 대한 국민적 불신의 심화가 주요 원인으로 대두되고 있다. 특히나 사법 시스템에 대한 불신과 불공정 평가의 원인이 과거의 경제적 불평등을 바탕으로 하는 절차적 불평등 논란에서 양형에 대한 불만으로 이동하고 있는 상황이다. 이러한 현상은 국가의 법치에 대한 국민적 믿음이 위협을 받는 상황이라 할 수 있다. 이에 따라, 우리 사회가 공유하는 정의감의 형성과 그에 수반하는 처벌욕구의 근원에 대해 진화심리학적 관점에서 고찰하였으며, 처벌강화를 요구하는 심리적 기제는 무엇인가에 대해 사회심리적 관점에서 설명을 시도하였다. 결론적으로 우리 사회는 지속되는 정의감을 위협하는 일련의 사건들로 인해 공동체 생존의 근간이라 할 수 있는 협동 의식이 손상받고 있다는 두려움과 이에 대한 법치의 무력함에 대한 분노가 자리잡고 있는 것으로 판단되었다. 관련하여 정의감에 대한 믿음과 법치에 대한 신뢰 회복을 위한 정책적 함의를 제시하였다.

다국어 초록 (Multilingual Abstract)

The perception of unfairness in our society as a whole is very high, and in the background the deepening of public distrust in the legislative authority and judicial systems is emerging as the main cause. In particular, the cause of distrust and unfair evaluation of the Judicial system is shifting from controversy over procedural inequality based on economic inequality in the past to dissatisfaction with sentencing, that is. low penal sentencing. This phenomenon can be said to be a situation in which public belief in the rule of law of the state is threatened. the formation of a sense of justice shared by our society and the source of the desire for punishment accompanying it were considered from an evolutionary psychological point of view, and the psychological mechanism that requires strengthening punishment was attempted from a social psychological perspective. In conclusion, it was judged that our society is afraid that the sense of cooperation, which is the basis of community survival, is being damaged by a series of events that threaten a sense of justice, and anger over the powerlessness of the rule of law is in place. In this regard, policy implications for restoring faith in a sense of justice and trust in the rule of law were presented.
