비의료인의 문신시술 합법화의 방향과 문신소비자의 권리 보장을 위한 체크리스트와 문신동의서 = Checklist and tattoo contracts to legalize non-medical personnel tattoos and to ensure the rights of tattoo consumers

국문 초록 (Abstract)

본 논문은 법원의 판례와 신문기사를 통하여 한국에서 음성적으로 이루어지고 있는 문신시술의 문제점을 살펴보고, 해외의 사례와 국내의 입법제안을 통해 문제점을 해결할 방안을 살펴본다. 현재 대한민국에서는 오직 의사만 문신시술을 할 수 있지만, 실제로 시술되는 대부분의 문신은 비의료인에 의해 이루어지고 있다. 본 논문은 이러한 문제점의 원인을 살펴보고, 비의료인에 의하더라도 문신시술이 안전하게 행해질 수 있도록 해외에서는 어떠한 조치를 취하고 있는지 살펴본다. 이를 종합하여 문신을 받는 문신소비자를 보호하기 위한 체크리스트와 문신을 하는 문신시술자의 설명의무를 다하도록 하는 문신동의서를 만들었다. 이는 대부분의 문신이 음성적으로 이루어짐에도 조속한 법 제정이 이루어지지 않고 있는 현실에서 문신소비지와 문신시술자를 보호하기 위함이다.

다국어 초록 (Multilingual Abstract)

This paper examines the problems of tattooing which is secretly conducted in Korea through court precedents and newspaper articles, and examines ways to solve problems through overseas cases and domestic legislative proposals. Currently, only medical practitioners can do tattooing in Korea, but most of the tattoos practiced are done by non-medical personnel. This paper examines the causes of these problems, and examines the ways in which foreign countries have adopted tattoos so that they can be safely performed even by non - medical personnel. Through this, I made a checklist to protect the tattoo consumers receiving tattoos and a tattoo agreement to fulfill the duty of the tattoo practitioner to explain the tattoo. This is to protect the tattoo consumer and the tattoo practitioner in the reality that the enactment of the law is not made at the moment even though most of the tattoos are spoken.
