국경 간 공급 규제 제도에 대한 고찰: 위성서비스를 중심으로 = A Study on Cross-Border Supply Regulation of Telecommunications Services-Focusing on Telecom Services by Satellite34

Limitations on cross-border supply of facilities-based telecommunications (hereinafter referred to as “telecom”) services was introduced to reflect the results of basic telecom services negotiation which was concluded in Feb. 1997. Korea currently allows any foreign service suppliers to provide telecom services only through commercial arrangements with licensed Korean service suppliers. Considering the difficulties of extraterritorial application of domestic laws to foreign service suppliers, this measure was taken by the authorities to secure regulation jurisdiction if there are any disputes between service suppliers and make them follow the rules regardless of their nationalities. Maintaining market order, protecting the rights of consumers, and preventing signals from being transferred to North Korea were other reasons behind this measure. This paper is focused on legal issues arising from cross-border supply of facilities-based telecom services by satellite and tries to present implications for policy review. In the short term, the authorities should apply the rules flexibly in order to promote effective competition and ease the market entry barrier which was established as a result of the lack of service suppliers. In the medium-long term, it should consider abolishing the limitations on cross-border supply itself because it is the best interests of the people and is in the right direction for the authorities to control the market by using market forces based on domestic regulations.
