노동법과 근대시민법과의 관계 = Relation between Labour Acts and Modern Civic Law

다국어 초록 (Multilingual Abstract)

Labour acts belong to special law which prescribes labouring relation in the capitalistic society. Modern civic law depends on freedom and principle of epuality. And it also prearranges abstract personality in the subject of law and so even oppression by the strong to the weak becomes raesonable.
Though laoburing relation is combination of possession and labour, labour acts are apart from civic law, while they are united each other. Though labour acts were derived from modern civic law, they treat the labour problems which modern civic law can't manage. Some assert that labour acts are a revision of civic law, but labour acts have their own structure of law and principle of law. Relation between labour acts and modern civic law, therefore, is not opposite.
Labour acts do not exclude personal freedom and equality, but seek to expand a
reasonable and practical freedon and equality to a aclass of worker.
In this sense, labour acts are based on modern civic law and they are closely related to modern civic law. And they spread liquid and rational direction.
