현행 공증제도에 있어서 번역공증의 문제점과 해결방안에 관한 연구 = Problems of Translation Notarization and their Solutions in the Current Notarial System in Korea

다국어 초록 (Multilingual Abstract)

Translation notarization is the legal activity officially authenticating the proper and precise translation of original and translated documents when documents are translated from the source language into the target language, vice versa, according to the needs of organizations including governmental organizations, public offices and administrative agencies, and so on. Translation notarization endows public trust and legal authority to the translated official documents. Under the current Korean notarization system, the translation notarization does not authorize the proper and precise translation of the documents from the source language to the target language, only just the factual activity of the translation by the translator. Accordingly, the current translation notarization in Korea in reality lacks the notarization that the translation, itself is proper and precise. This study proposes three solutions to address these issues of translation notarization of the translated contents. First, the certificates of translation issued by certified public translators should perform the function of translation notarization. Second, certified public translators should be qualified as translation notaries. Third, public notaries whose English proficiency has been verified should be allowed to perform translation notarization. For these solutions to be implemented, the matters of translation quality assessment should also be addressed. In practice, there may be some difficulties in implementing these proposals due to conflicts of interests among the parties concerned, such as public notaries and certified public translators, regarding translation notarization. Accordingly, as international exchange and cooperation is accelerating in Korea today, the demands for the translation of documents, including legal documents, will be expected to greatly increase. In this context, there will be a much higher demand for the translation notarization. Therefore, supplementary measures suggested herein should be implemented to solve the problems of current translation notarization.

국문 초록 (Abstract)

번역공증이란 출발언어가 한국어이며, 목표언어가 외국어이든, 출발언어가 외국어이며 목표언어가 한국어이든, 법률문서를 비롯하여 각종 문서가 번역공증을 필요로 하는 기관의 요청여부에 따라 번역이 수행되고, 출발언어로 된 문서와 목표언어로 번역된 문서가 상호 그 내용에 있어서 차이가 없음을 공적으로 인증하는 법률행위이다. 이러한 번역공증은 번역물에 공문서로서 공신력과 법적 권위를 부여한다. 현재의 한국의 번역공증 제도 하에서는 출발언어에서 목표언어로 적확한 번역이 수행되었다는 사실을 공증하기 보다는 번역자의 번역행위에 사실인증의 기능밖에 수행이 되지 않고 있다. 따라서 출발언어에서 목표언어로의 번역물에 대한 번역내용에 대한 공증은 결여되어 있는 것이 현실이다. 본 연구에서는 번역내용에 대한 번역공증을 실행하기 위하여 첫째, 번역공증에 관하여 번역행정사의 번역확인증명서가 번역공증에 갈음하여 번역공증의 기능을 수행하도록 하는 방안, 둘째, 외국어번역행정사에게 번역공증의 자격을 부여하는 방안, 셋째, 영어능력을 검증받은 공증인이 번역공증 행위를 할 수 있도록 하는 방안을 제시하였다. 이러한 방안이 수행되려면, 부수적으로 번역결과물에 대한 품질 평가의 문제 역시 다루어져야 한다. 사실 본 연구에서 제시하는 방안이 번역공증을 대상으로 공증인과 외국어번역행정사 등 관련 당사자 간의 이해와 유관기관의 업무가 복합적으로 얽혀 있어 그 시행에는 어려움이 있을 수 있다. 오늘날 한국은 국제협력 및 교류가 더욱 더 증대됨에 따라 이에 따른 법률 문서의 통번역에 대한 수요도 역시 증대될 것으로 예상되고, 이러한 시대적인 맥락에서 번역공증의 수요도 더욱 증가일로에 있다. 따라서 이러한 현실에 직면하여 이러한 제도적 보완을 통해 현행 번역공증의 문제는 반드시 해결되어야 할 필수적인 사안으로 사료된다.
