롤즈의 자유의 우선성에 대한 비판적 재해석

국문 초록 (Abstract)

이 논문의 목적은 롤즈의 자유의 우선성에 대한 비판을 검토하고 그의 자유 개념을 분석하여 자유의 우선성을 지지하는 보다 유연한 해석의 확장 을 제안하는 것이다. 정의의 두 원칙은 자유의 우선성에 따라 제1원칙의 기 본적 자유들에 대한 평등한 권리가 보장되고 나서, 제2원칙의 공정한 기회 균등의 원칙이 적용되며, 그런 다음에 경제적 불평등의 혜택이 모두에게 이익이 가게끔 편성한 차등원칙이 작동가능하다. 롤즈는 원초적 입장의 개 인들이 물질적인 가치보다 자유를 선호한다고 설명하지만, 일반적으로 사 람들은 경제적 이득을 위해 어느 정도는 자유를 포기한다. 엄격한 자유의 우선성이 정당한가에 대한 비판은 그래서 있어 왔다. 쟁점은 제1원칙에서 정치적으로 보장한 동등한 자유가 실질적으로는 경제적 형편에 따라 동등 하지 못한 것이다. 롤즈는 자유와 자유의 가치를 구분하고 자유는 동등하 더라도 그러한 자유를 활용하는 능력인 자유의 가치는 동등하지 못하다고 했다. 만일 제1원칙의 보장만으로는 동등한 시민의 지위가 확보되지 못한 다면, 제1원칙의 자유가 제2원칙의 차등원칙을 포용하여 보다 현실화되는 방안을 모색할 필요가 있다. 본 논문은 자유와 자유의 가치가 연결된 롤즈 의 자유 개념을 도출하여 자유의 우선성 비판에 대응하는 보다 유연한 해 석의 토대를 마련하고, 이에 따라 자유와 그 자유의 가치가 결합된, 즉 제1 원칙의 자유와 제2원칙의 차등원칙이 조건부로 자유의 우선성을 지지하는 새로운 해석을 제안한다. 롤즈도 자유의 우선성은 일정 정도의 경제적 수 준이 만족된 사회에서 가능하다고 보았다. 문제는 그러한 수준에 이르기 전에기본적자유가포기될수있는것과설령그러한단계에이른다해도 자유의 우선성이 얼마나 안정적일 수 있는가 하는 것이었다. 하지만 본 논문에서 제시하는 ‘자유의 두 원칙’이 적용된다면 롤즈가 강조한 자유의 우 선성은 보다 현실적이고 안정적인 이론으로 지지될 수 있다.

다국어 초록 (Multilingual Abstract)

This aim of the study is to develop a more flexible interpretation supporting the priority of liberty in Rawls with an examination about the criticisms of the priority of liberty and analysis of the conception of Rawls’ liberty. Two principles of justice are serially ordered by the priority of liberty : the basic liberty is always equal, and there is the principle of fair equality of opportunity, then the economic inequalities are to be arranged for everyone’s advantages by difference principles. Although Rawls explained that all parties in the original position prefer the equal liberty to economic benefits, people generally may give their some liberties up for the sake of greater economic benefits. Therefore, there have been the criticisms on the justification of the priority rule. The major issue lies in the basic liberties are guaranteed by the first principle are socioeconomically not equal depending upon the greater authority and wealth. If there is a specific case in which the equal citizenship is not solely guaranteed with the first principle, we need to come up with a more realistic substantive way by embracing the second principle. Rawls distinguished liberty from the worth of liberty and liberty of equal citizenship is same for all but the worth of liberty is not the same for everyone. This study deduces to find a basis of more flexible interpretation responding to criticisms of the priority rule by analyzing the conception of Rawls’ liberty that liberty and the worth of liberty are linked. A new interpretation basis on this finding combined liberty and the worth of liberty(can be called as ‘two principles of liberty’) is suggested: i.e., the liberty of the first principle and the difference principle of the second principle are conditionally cooperated together only for supporting the priority of basic liberties. Rawls also thought the priority of liberty comes into play in the society under certain favorable socioeconomic conditions. The problems are, firstly, people may give up liberties for the greater economic benefits if they wish until the point is reached to the favorable condition, and secondly, even when such time arrive, it is difficult to secure the stability of regulation by the priority of liberty. But those problems will be resolved by means of adopting this ‘two principles of liberty’ and the priority of liberty in Rawls’ will, correspondingly, be chosen as a more realistic and stable theory.
