전략환경평가의 개선방안 : 도시계획을 중심으로 = Development of Strategic Environmental Assessment in Korea : with special reference to Urban Planning

국문 초록 (Abstract)

환경영향평가제도는 대규모 개발사업을 대상으로, 계획이 확정된 후 사업 실시단계에서, 개발사업 시행에 따른 환경영향 저감방안을 중점 검토하는 제도인데 비하여, 사전환경성검토제도는 행정계획과 환경상 민감지역의 소규모 개발사업을 대상으로, 계획이 확정되기 이전단계에서, 입지나 개발의 적정성·타당성을 환경적 측면에서 사전 검토한다는 점에서 큰 차이가 있다.
환경정책기본법 및 동법 시행령이 2005년 5월 개정됨에 따라, 사전환경성검토제도는 2006년 6월부터 대상 행정계획을 구체적 개발사업의 상위 행정계획으로 확대하고, 계획의 적정성, 입지의 타당성을 미리 검토할 수 있도록 하고, 검토과정에서 주민, 전문가, 시민단체 등 이해관계자의 의견수렴을 거치도록 하는 전략환경평가체제로 개편됨으로써, 환경갈등이나 사회·경제적 문제를 예방할 수 있는 기반이 보다 강화되었다. 그리고 개발사업에 대한 사전환경성검토는 현행 절차와 방법을 따르지만, 행정계획의 경우 대안검토 및 스코핑(scoping)을 위한 환경성검토협의회 구성 및 설명 회·공청회 등 주민의견수렴절차를 추가적으로 이행하도록 되었다.
전략환경평가는 사전환경성검토제도에 도입되어 시행중임에도 불구하고 여전히 문제점이 남아 있다. 특히 도시계획에 대한 사전환경성검토 즉 전략환경평가는 사전 환경성검토업무매뉴얼에 비교적 상세하게 제시되어 있으나 도시계획과 환경계획의 연계부족과 중복, 평가기준의 미흡 등의 문제점을 가지고 있다.
따라서 본 연구는 특히 도시계획에 대한 사전환경성검토 현황을 고찰한 후 도시계획에 대한 전략환경평가의 개선방안으로 첫째 전략환경평가시 기준으로 수질오염총량관리제와 대기오염물질 배출허용총량제의 도입, 둘째 도시계획과 환경계획과의 연계와 통합, 셋째 도시계획에 대한 사전환경성검토와 도시개발사업에 대한 환경영향 평가간의 연계를 제시하였다.

Since 1981, environmental impact assessment(EIA) has been introduced in the decision-making process for the consideration of the environmental impact of large scale development project in Korea. But such project-EIA process has been carried out only after policies or plans or strategic decisions have been already fixed.
In order to overcome such problems of project-EIA, Prior Environmental Review System(PERS) has been introduced for the consideration of the environmental impact of administrative plans directly concerned with development projects and the small scale development projects in environmentally sensitive area. Based on the Basic Environmental Policy Act Amendments of 1999, PERS can have the legal foundation. But strategic environmental assessment(SEA) has become introduced in incomplete state.
Environmental Policy Act Amendments of 2005 has added the concepts of SEA such as expansion of kinds of administrative planning, earlier timing of environmental assessment on development planning, and public participation into PERS. But the SEA on urban planning has still some problems, even though there is the Manual on PERS published by Ministry of Environment of Korea.
In this paper, the present system and the problem of SEA on urban planning will be described. And then SEA reflecting Total Water and Air Pollution Load Management System, the linkage and integration of urban planning and environmental planning, and the linkage of SEA on urban planning and EIA on urban development project are suggested.
