13세미만 대상 성범죄 양형에 관한 경험적 연구 = 제1기 양형기준 적용현황 분석

국문 초록 (Abstract)

본 연구는 2009년 제1기 양형기준이 적용되는 8개 범죄군 중, 성범죄의 세부항목인 13세미만 대상 성범죄의 양형기준 적용현황을 분석한 것이다. 본 연구에 사용된 자료는 대검찰청 사건처리정보시스템(Prosecutorial Guideline System: PGS)에서 획득된 13세미만 대상 성범죄 사건의 모수를 기본으로 하며, 특히 2009년 7월 1일 ~ 2010년 6월 30일까지 공소 제기되어 제1심 유죄판결을 받은 248건의 사건이 분석에 사용되었다. 본 연구는 이들 범죄의 세부 유형별 형량분포, 양형기준 부합률, 양형인자의 적용빈도와 영향력을 기술통계와 t-test, 그리고 다변량 회귀분석을 사용하여 평가하였다. 전체 집단을 대상으로 한 회귀분석 결과, 양형기준에서 명시하고 있는 다양한 양형인자들 중에서 가중인자들의 영향력이 컸으며, 특히 특별가중요소인 특강 해당 없는 동종누범의 영향력이 두드러졌다. 더욱 구체적으로, 13세미만 대상 성범죄의 대다수인 제1유형(강제추행 등 의제강간) 사건만을 독립적으로 회귀분석한 결과, 특별감경요소인 폭행·협박 아닌 위계·위력 사용, 행위가 의제 강제추행인 경우, 농아자, 일반감경요소인 형사처벌전력 없음, 특별가중요소인 특강해당 없는 동종누범, 그리고 일반가중요소인 계획적 범행과 이종·동종 및 폭력실형전과여부가 양형변이를 설명하는데 유의미한 인자로 나타났다. 한편, 법 외적 요인이며, 사회인구학적 변수인 연령과 교육수준의 영향력은 통계적으로 유의미하지 않았다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to analyze the status quo of the application of the first Korean sentencing guidelines for sexual offenders against children. The data were obtained from the Prosecutorial Guideline System (PGS) of the Supreme Prosecutors" Office, Republic of Korea. Based on the PGS data archive, we selected 248 available population cases of sexual offenders against children which were sentenced from July 1st, 2009 to June 30th, 2010. To describe the type of the crime, we mainly used basic descriptive statistics, and t-test. In addition, the OLS regression was used to explore the power of explanation of the included sentencing factors as a model of sentencing for sexual offenders against children. The sexual offenses against children are categorized into three subtypes of sexual molestation, forcible non-penetrative sex, and rape. The results contain the frequency of the each sentencing factor, type of the decision, length of the sentence, the compliance record, mean difference of the length by the sentencing factor, power of the explanation of the sentencing factors in the context. Moreover, the OLS regression result is showing that the model of the sentencing guideline for sexual offenders against children is good as indicating the R<SUP>2</SUP>is higher than .30. Also we found that the special aggregation factors have relatively stronger power of influence among the factor on the model of the sexual offenders against children. The extra-legal variables are not statistically significant on the result. The detailed significance and detailed policy implication will be discussed in the context.
