제주자치경찰제의 변화와 박근혜 정부 자치경찰제의 전망

국문 초록 (Abstract)

2015년 10월 21일은 우리나라 국가경찰이 창설된지 70주년을 맞는 날이다. 2006년 7월 1일 제주특별자치도에서만 유일하게 시행된 자치경찰제는 우리 경찰사에 큰 획을 긋는 의미를 지니고 있다. 비록 제주특별자치도에서 국가경 찰은 그대로 두고 도지사가 별도로 자치경찰공무원을 모집해 봉급과 연금을 지 급하는 방식이지만 그 도입은 엄청난 의미를 지니게 되었다. 최초 38명의 국가 경찰을 이관 받아 출범한 제주자치경찰제는 2015년 2월 기준 134명(추가로 중 국어 분야 9명 특채)으로 증가하는 발전을 보여주었다. 우리나라 자치경찰제는 본론에서 보는바와 같이 시작은 미미했으나 그 조직은 지속적으로 확대되었으 며 예산의 경우도 매년 증가하고 있다. 자치경찰공무원들의 권한에 있어서도 점차적으로 확대되어 나가고 있을 뿐만 아니라 승진과 계급 및 예산분야에서도 많은 확대 변화를 보여주고 있다. 제주도지사와 제주지방경찰청장 간에 업무협 약에 따라 극히 제한된 업무를 수행하고 있기는 하지만 이와 비슷한 모델을 운 영하고 있는 프랑스, 스페인, 이태리의 자치경찰제보다 훤씬 더 큰 권한을 가지 고 넓은 업무를 수행하고 있다는 특징도 보여준다. 제주자치경찰제는 이명박 정부를 거쳐 박근혜 정부에서도 적극적으로 전국에 도입하려는 자치경찰제 모 델에 있어서 중요한 벤치마킹의 대상이 될 것으로 보여진다. 올 2015년은 1991년 우리나라에 지방자치제가 도입된지 25년이 되는 해다. 지방자치 시대 를 맞이한지 25년이 되었고 자치경찰의 권한 면에서도 전면적으로 자치경찰제 를 도입하는 것은 어렵다고 보여지는 만큼 지방이 잘할 수 있는 치안분야만이 라도 지방으로 넘겨주어야 한다는 시각이 학계나 박근혜 대통령의 시각을 통해 설득력을 얻고 있다. 국가경찰에서도 100% 국가경찰제로 운용해야만 한다는 시각에서 이제는 부분적이나마 자치경찰제 도입에 관한 연구가 필요하다고 보 는 시각이 강하다. 본 논문에서는 제주자치경찰의 권한 확대변화와 박근혜 정 부의 자치경찰제 도입에 관해 분석했다.

다국어 초록 (Multilingual Abstract)

October 21, 2015 is the 70th anniversary of Korea's National Police Agency. The autonomous police system implemented on July 1, 2006 only in Jeju has an important implication which makes a stroke in the history of Korea national police. Although this system is operated in a way that the governor of Jeju recruits autonomous police officers and pay their salaries and pensions independently from the national police, whereas the national police is still maintained, its introduction had a great implication. Jeju autonomous police system which began with 38 police officers transferred from national police agency showed development with increased number of officers to 138 as of February, 2015 (including special recruitment of additional 9 officers in Chinese field). The beginning of autonomous police system in Korea was humble as discussed in the text, the organization continues to expand and its budget also increases year to year. The authorities of autonomous police officers increase gradually, and there are many changes and expansion in promotion, class and budget areas. Although they perform a very limited range of works in accordance with the MOU between Jeju governor and Jeju Police Agency Commissioner, they have much greater authorities than those in France, Spain and Italy which also operate similar model as Jeju autonomous police system. Jeju autonomous police system is expected to be a benchmarking target in autonomous police system model which Park Administration actively tries to introduce in a nation-wide scale as well as Lee Administration. Year 2015 is 25th anniversary of local self-government system which was introduced in 1991. As the local self-government system is 25 years old and it is considered to introduce full-scale autonomous police system difficult in terms of the authorities of autonomous police, the academic opinion that at least public order that local self-government may do better than central government shall be transferred to local government increasingly holds the water in academics and through the perspective of president Park. With respect to national police, the opinion begins shift from the one that it has to be operated 100% by the national police system to the one that the study on autonomous police system is required. This study examines the expansive changes in authorities of Jeju autonomous police and introduction of autonomous police system by Park Administration.
