미국의 재난대응체계의 규범적 고찰과 시사점 = A Normative Study on the Disaster Management System of the United States and its Implications

Since there have been many natural disasters and terrors constantly, each country in the world has been trying to develop and organize the disaster management systems and legal frameworks. Especially, after 9ㆍ11 terrorists attack and a catastrophic hurricane Katrina in the United States, the federal government has reorganized the integral disaster management system in order to efficiently handle the crisis, and to administrate assistance to the victims of the disasters, newly establishing Department of Homeland Security and relocating the Federal Emergency Management Agency under the Department of Homeland Security. As such, after Korea has suffered the Sewol ferry disaster, many criticisms have occurred with respect to the inefficiency and inexpert crisis management system. Hence, the Korean government has also established the Ministry of Public Safety and Security in order to efficiently rescue and assist the disaster victims, reorganizing the disaster management systems and revising the disaster and security management act. The ministry of Public Safety and Security should be playing an important role as a control tower like the Department of Homeland Security of the United States over the variety of disasters, based on the revised disaster and security management act. In this regard, this article focuses on the normative examination of the federal crisis management system of the United States in details, which, hopefully, allows many practical implications to the Korean crisis management system in the future.

국문 초록 (Abstract)

자연적 및 인위적 재난 혹은 재해가 빈번하게 발생하면서 세계 각국은 이러한 사태에 효율적으로 대응하기 위한 재난관리체계 및 법제도를 정비하고 있다. 미국은 9ㆍ11테러 사태 및 허리케인 카트리나 사건 이후로 연방정부와 주(州) 및 지방정부간의 재난대응체계가 효율적으로 운영되도록 국토안보부(Department of Homeland Security)를 신설하여 산하에 연방비상사태관리청(Federal Emergency Management Agency)을 두도록 통합관리체계와 관련 법제를 정비하였다. 우리나라도 세월호 참사 이후에 국가의 위기관리시스템과 전문성에 대한 비판의 여론이 일자 국민안전처를 신설하여 재난의 예방, 대비, 대응 및 복구의 통제탑(control tower)의 역할을 수행하도록 「재난 및 안전관리 기본법」을 개정하였다. 보다 전문적이며 신속하고도 효율적인 위기관리 및 재난대응을 위해서는 중앙정부와 지방자치단체가 유기적으로 협조하여 재난업무분장의 적실성을 높여야한다. 우리나라의 재난관리체계에 있어서도 먼저 중앙정부가 체계적인 통합관리체계를 수립하여 국가재난사태에 효율적이고도 적극적으로 대응할 수 있도록 해야 하며, 국가와 지방자치단체 간의 책무, 즉 공공영역에서의 재난관리체계의 조직적ㆍ유기적 구성을 도모해야 한다. 이에 더하여 민간영역에서의 자원을 활용할 수 있도록 재난관련법제를 정비하는 것이 시급하다. 미국의 연방재난관리체계와 재난관리법제를 검토하는 것은 우리나라의 유기적이고도 조직적인 재난 예방, 대응 및 처리 체계를 재정비하고 조직하는데 있어 여러 시사점을 줄 수 있을 것으로 생각된다. 특히 미국의 연방위기관리시스템 하에서 연방정부와 주(州)정부 및 지방정부 간의 유기적인 협력체계와 조정기능 및 민간영역 자원활용체계 등의 구체적인 내용들에 주목하여 앞으로 우리의 재난과 위기관리 법제 개선에 참조할 필요가 있다.
