대학생들의 온라인 저작권침해 원인과 대책 연구모형의 검증: 불법 다운로드와 업로드의 비교 = A Test of a Model for Causes and Counterpart in Digital Piracy: Comparing Illegal Download with Upload Behavior

국문 초록 (Abstract)

이 연구는 온라인 저작권침해행위의 설명에서 원인요인들의 영향력을 살펴보고 원인요인들의 작용에 대한 통제요인들의 완충효과에 관한 연구모형 검증을 통해 그 대응책을 알아보고자 했다. 이 연구는 저작권침해를 불법 다운로드와 불법 업로드로 구분하여 살펴보자 했고 다운로드와 업로드에 그 원인 및 대응책에 차이가 있는지를 살펴보았다. 이 연구는 불법 다운로드와 업로드의 원인 요인으로 여러 동기요인들, 개인성향으로 낮은 자기통제력 및 사회학습 환경요인으로 저작권침해자와의 차별접촉과 하위문화, 그리고 통제요인들로는 저작권침해의 사법적, 사회문화/윤리적, 기술 상황적 대책에 따라 공식처벌, 도덕태도, 기회제약을 중심으로 그 원인 및 통제요인들의 모형 및 상호작용효과를 불법 다운로드와 업로드에 각각 검증했다. 본 연구의 분석결과 원인요인으로 여러 동기요인들 중에서는 정보공유를 제외하고 그 외 요인들의 영향은 미약했다. 개인성향으로 낮은 자기통제력의 영향은 불법 다운로드와 업로드 모두에서 낮았으나 사회학습 등의 환경요인으로 주위 저작권침해자 친구와의 접촉은 불법 다운로드와 업로드 모두에서 매우 크게 중요했고 하위문화도 유의미한 영향력을 갖는 것을 제시했다. 본 연구에서 관심을 갖는 원인요인들과 통제요인들 간의 상호작용효과를 보면 불법 다운로드에서는 원인요인들과 통제요인들과의 상호작용효과가 모두 유의미하지 않았다. 그렇지만 다운로드의 경우와 달리 업로드에서는 불법 업로더 친구와의 차별접촉과 공식처벌인지간의 상호작용효과가 부(-)적으로 유의미했고, 또한 정보공유의 동기와 공식처벌인지간의 상호작용효과가 부(-)적으로 유의미해 주위 불법 업로더와의 접촉의 원인작용과 정보공유의 동기를 공식처벌이 어느 정도 저지할 수 있음을 제시했다. 이는 업로드의 경우 공식처벌이 통제요인으로 어느 정도 중요하다는 것으로 다운로드와 차이를 보였다.

다국어 초록 (Multilingual Abstract)

This study considers both causal and control factors for explaining digital piracy and tests their interaction effects for examining buffering effects of control factors in both illegal download and upload behavior. This study examines the effect of low self-control, four motivational factors, and differential association and subcultural environmental factors as causal factors. It also considers three control factors such as legal punishment, morality, and lack of opportunity and test their interaction effect. Empirical results show that low self-control and almost motivational factors have no significant effect on both download and upload behavior. However, social learning factors such as association with illegal downloader or uploaders have strong effects on both download and upload behavior. It is found that the interaction effects between causal factors and control factors are not significant in download behavior. However, the interaction effect between association with illegal uploaders and perceived legal punishment is negatively significant and the interaction effect information sharing motive and perceived legal punishment is also negatively significant. Those results show that legal punishment can be a major countermeasure against illegal digital uploader piracy.
