디지털 환경에서의 지적재산의 보호와 유통에 관한 소고 : 특수한 유형의 온라인서비스제공자를 중심으로 = An Analysis of Intellectual Property Right Enforcement and Distribution in the Digital Environment

국문 초록 (Abstract)

특수한 유형의 온라인 서비스 사업자의 법적 책임에 대해 법학적 차원에서는 다수의 선행 연구가 이루어졌다. 하지만 산업적 기술적 차원에서는 논의가 부족하다.
본 고에서는 법적인 측면에서는 이미 학계에서 논란이 된 바 있는 적극적 필터링 개념이 언급된 ‘소리바다5 사건’과 웹하드 업체에게 방조책임을 인정한 ‘웹하드 사건’을 산업적, 기술적 시각에서 접근 · 분석하였다.
디지털 콘텐츠 유통을 활성화하고 문화산업을 육성하기 위해서는 무엇보다도 새로운 기술에 대한 이해와 이에 대한 적절한 저작권관련 제도의 도입이 필요하다. 공유방식의 콘텐츠유통이 거스를 수 없는 대세라고 한다면, 이에 대한 빠른 기술적 대응과 저작권 정책의 정비 등을 통해 저작권 산업, 나아가서는 문화산업이 성장할 수 있는 기반을 만들어야 할 것이다.

다국어 초록 (Multilingual Abstract)

Discussion about Industrial and technical perspectives are insufficient, even there were manifold researches about the particular type of On-line Service Provider's legal responsibility from the jurisprudence point of view. This article covers the research and analyzes a case of 'Soribada5' adjudication in the industrial and technical point of view and that is the first court's adjudication about the particular type of on-line service provider's active aid and abet in the field of copyright infringement. First of all, sufficient understandings of new technology and appropriate copyright law are needed to invigorate the culture industrial and digital contents distribution. If assuming the sharing kind of contents distribution is the big wave, the copyright and culture industry could grow up through the rapid technical response and modifying copyright policy.
