동물학대 범죄 현장에서 수의법의학 활용의 필요성; 수사경찰관의 역할과 현장대응 문제점 = The Necessity of Utilizing Veterinary Forensic Medicine in Animal Abuse Crime Scenes; The Role of an Investigative Police Officer and the Challenges in Field Response

국문 초록 (Abstract)

최근 한국에서 반려동물 보유 가구의 증가와 함께 동물 학대 범죄가 지속적으로 증가하고 있다. 이러한 상황에서 동물 학대 행위에 대한 과학적 입증의 중요성이 부각되며, 수의법의학 검사가 동물 학대사건의 사인 규명에 필수적인 역할을 하고 있다. 2023년 개정된 「동물보호법」은 동물 학대 행위를 보다엄격히 처벌하기 위한 법적 근거를 마련하고, 수의법의학적 접근을 통해 사건의 과학적 분석을 가능하게하고 있다. 그러나 현행법상 동물 구조와 보호의 주체는 지방자치단체로 규정되어 있음에도 불구하고, 동물 관련 범죄의 신고는 주로 경찰서에 접수되어 수사 과정에서 여러 문제점이 발생하고 있다. 특히, 담당수사관의 수의법의학적 지식 부족, 현장 감식 매뉴얼 부재, 지방자치단체와의 협력 미비 등이 문제로 지적된다. 본 연구는 동물 학대 신고 시 초동 조치의 중요성을 강조하고, 수의법의학을 활용한 현장 감식 매뉴얼 구축의 필요성을 논의한다. 이를 통해 동물 학대 사건에서의 과학적 수사의 중요성을 부각시키며, 실질적인 수사 개선 방안을 제안한다.

In recent years, the number of households owning pets in South Korea has been steadily increasing, and along with it, incidents of animal abuse have also risen. The importance of scientifically proving animal abuse has become more pronounced, with veterinary forensic examinations playing a crucial role in determining the cause of death in such cases. The 2023 amendment to the Animal Protection Act has established a legal basis for stricter punishment of animal abuse, enabling a more systematic approach to investigating these crimes. Although the current law designates local governments as the primary entities responsible for the rescue and protection of animals, most animal-related crime reports are handled by police stations, leading to various issues in the investigative process. These problems include a lack of veterinary forensic knowledge among investigators, insufficient field investigation manuals, and poor cooperation between local governments and police. This study emphasizes the importance of initial response measures in cases of animal abuse reports and discusses the necessity of establishing field investigation manuals that incorporate veterinary forensic science. Through this, the study highlights the significance of scientific investigation in animal abuse cases and proposes practical improvements to the investigative process.
