주한몽골대사관이 인접 토지의 경계를 침범한 사안에서, 대상판결은 토지 소유자의 건물철거・토지인도청구를 각하하면서 부당이득반환청구는 인용하였다. 네덜란드 외교공관을 둘러싼 유사한 사안에서 선례는 외교사절의 특권・면제를 유추적용하였고, 대상판결의 하급심은 이러한 선례를 따랐으나, 대상판결은 이와 달리 주권면제를 적용하였다. 양자는 서로 구별되는 제도로서, 외교공관을 둘러싼 분쟁이라 하여 무조건 외교사절의 특권・면제가 적용되는 것은 아니고, 파견국 자체가 분쟁주체가 되는 경우 주권면제가 적용된다고 봄이 옳다.
그런데 부동산을 둘러싼 분쟁으로 인한 소송은 전형적인 비주권적・私法的 영역에 속하므로, 제한적 주권면제론을 일관적으로 관철한다면 건물철거・토지인도청구에 대해서도 재판권을 행사하여 본안에 나아가 이를 인용하였어야 할 것이다. 제한적 주권면제론은 기본적으로 주권면제를 제약하기 위한 이론이라는 점에서, 비주권적・私法的 영역에서의 주권면제 배제는 예외가 아닌 원칙의 지위를 갖기 때문이다. 대상판결은 관습국제법으로 받아들여지는 제한적 주권면제론의 시각만으로는 이해하기 어렵다.
대법원은 제한적 주권면제론을 도입할 당시, 외국 국가의 비주권적・私法的 행위도 주권적 활동에 속하거나 이와 밀접하게 관련되어 있어 그에 대한 재판권의 행사가 주권적 활동에 대한 부당한 간섭이 될 우려가 있다는 등의 특별한 사정이 있다면, 예외적으로 주권면제가 인정될 수 있다고 판시하였다. 대상판결은 이러한 특별한 사정이 인정될 수 있는 경우로서 법원에 제기된 소송이 “외교공관의 직무 수행을 방해할 우려가 있는 때”라는 기준을 제시하였고, 부당이득반환청구권의 행사는 물권적 청구권의 행사와 달리 그러한 우려가 없다고 판단하였다. 위와 같은 기준은 기존 판례에서 찾아볼 수 없는 것으로서, 대상판결에서 새롭게 제시되었다.
즉 우리 판례가 애당초 관습국제법으로서의 제한적 주권면제론을 그대로 수용한 것이 아니라, 그보다 주권면제의 범위를 확장할 수 있는 예외의 여지를 남겨 두었다고 이해할 때, 비로소 대상판결의 태도를 정확히 설명해 낼 수 있다. 대상판결은 비주권적・私法的 행위에 대해서도 재판권이 면제될 수 있음을 보임으로써 제한적 주권면제론보다 적극적・전향적으로 주권면제를 인정한 것이고, 이는 기존 판례가 내포하고 있던 예외의 여지를 구체화한 것으로 평가할 수 있다.
대상판결의 결론이 토지 소유자의 권리 구제라는 측면에 있어 타당한지는 별개의 문제이다. 물권적 청구권과 부당이득반환청구권의 발생원인이 된 사실관계가 동일하다는 점에서, 후자만 인용하고 전자에 대하여는 재판권을 행사조차 하지 않은 것은 권리 구제의 관점에서 다소 미흡함이 사실이다. 재판권으로부터의 면제가 부인되더라도 여전히 강제집행으로부터의 면제가 남아 있다는 점 또한 장애물이 된다. 보다 실효적으로 국민의 권리・이익을 구제하기 위한 방안으로, 사법공조를 통한 국제법상 특권・면제의 통제를 모색해 볼 시점이다.

In this case where the diplomatic mission of the Mongolian Embassy in Korea infringed upon adjacent land property, the Supreme Court dismissed the claim for removal of the invading building and delivery of the corresponding plot of land due to lack of standing. A similar precedent concerning the premises of the mission of the Dutch Embassy denied the locus standi of the plaintiff per analogy of Article 31 paragraph 1(a) of the Vienna Convention on Diplomatic Relations. Au contraire, the Supreme Court applied the doctrine of sovereign immunity in this case, thereby clarifying the distinction between the two different sets of immunity.
Of note is that the Supreme Court, while granting immunity from jurisdiction regarding real rights, admitted the claim for recovery of unjust enrichment inured from the unlawful occupation and usage of land. The orthodox doctrine of restrictive sovereign immunity recognizes exceptions to immunity, among which is included proceedings related to the determination of any right, interest, or obligation of a foreign State regarding its possession or use of immovable property within the State of the forum. Disputes regarding land property are seen as a paragon of acta jure gestionis, and as such, the matter in issue cannot be properly explained from the customary perspective of restrictive sovereign immunity.
Back in 1998 when the Supreme Court adopted restrictive sovereign immunity, it was ruled that if a certain actum jure gestionis is closely connected to acta jure imperii so that the exercise of jurisdiction upon which may constitute unwarranted interference, then immunity from jurisdiction may also be granted for that act. In the present case, the court gave substance to this exceptional circumstance by providing the standard of “whether the trial may disturb the performance and function of the diplomatic mission,” adjudicating that the pecuniary claim seeking recovery of unjust enrichment does not cause such disturbance. This particular standard is not found in previous jurisprudence, but was first declared in this case.
Only by interpreting the Supreme Court’s jurisprudence as having modified the doctrince of restrictive sovereign immunity by permitting the possibility of immunity for acta jure gestionis, can we clearly comprehend this ruling. By virtue of that very possibility was achievable the extension of sovereign immunity into what was traditionally considered as located outside its scope and reach. The true significance of this case lies within its sui generis acknowledgment of sovereign immunity.
Nonetheless, the deference shown to international law by the Supreme Court inescapably reduces the range of recourse the property owner may seek. The bestowal of immunity was selective, in that claims based on real rights were dismissed contrary to the monetary claim. Taking into account not only the factual circumstances but also the complementarity of legal natures, such selective admission lacks justification. Even more limiting is the immunity from judgment enforcement. It is time to seek out more effective remedies, such as judicial mutual assistance that realizes waivers for various immunities in international law.
