일반적으로 평화조약은 법적으로 전쟁상태를 종식시키고 평화 상태를 복원하기 위하여 체결된다. 제2차 대전 후 패전국 독일은 별도의 평화조약이 체결되지 않은 채 전승국의 분할 통치를 받았다. 하지만, 이태리와 일본에 대해서 전승국은 각각 평화조약을 체결하였다.
평화조약 내 영토조항은 패전국의 영토를 처분하는 규정이다. 대이태리 평화조약에서 이태리는 자신이 제국주의정책을 적극적으로 표방하던 시기 확보하였던 지중해의 수많은 도서를 포기하였다. 대일 평화조약에서는 일본이 포기하는 도서의 처리가 명확하지 않다. 이로 인하여 독도가 대일평화조약 제2조 (a)호의 적용대상인지의 여부에 대해서 논란이 많다.
대일 평화조약은 다자조약의 형식이지만, 대일 평화조약 제4조 규정에 따라서 평화조약의 세부적인 사항을 별개의 특별약정에서 양자적 차원에서 처리하도록 하였다. 대일 평화조약 제4조 (a)호 규정에 근거하여 대한민국과 일본은 1965년에 협정을 체결하기도 하였다. 하지만 이들 양자 조약에서는 한반도의 지배로 인한 일본의 책임에 관한 사항을 명확하게 처리하지 못했다.
대일 평화조약에서 영역과 관련하여 실질적으로 유일한 규정이라고 할 수 있는 제2조에서는 패전국 일본의 영역 처리를 명확하게 규정하지 않아서, 여러 가지 해석이 가능하고, 일본과 한국, 중국, 러시아 사이에는 대일 평화조약 제2조의 해석과 관련한 논란이 끊이지 않고 있다. 대일 평화조약의 영토조항을 해석하는 문제는 아직도 미해결 상태라고 말할 수 있다.

다국어 초록 (Multilingual Abstract)

A peace treaty is made to deal with post-war situations between belligerent states and restore peace to them. After the end of the Second World War, there was no peace treaty between defeated Germany and the victorious Allied Powers. Unlike Germany, however, the Allied Powers made peace treaties with Italy and Japan respectively.
The Peace Treaty with Italy in 1947 clearly provides in various provisions which territory Italy shall renounce. Compared to the Peace Treaty with Italy, Article 2 of the Peace Treaty with Japan in 1951 is the only one provision, in substance, for the disposition of Japanese territories. For the worse, Article 2 is not very much clear about the title holder of the disposed territories. The term “Korea” used in Article 2(a) is interpreted to indicate neither the Republic of Korea (ROK) nor the Democratic People’s Republic of Korea (DPRK). It does not settle the question as to whether it covers Dokdo/Takeshima as one of the islands renounced by Japan. In contrast,
Article 4(a) of the Peace Treaty with Japan provides for special arrangements to be made between Japan and administering authorities in the territories referred to in Article 2. Japan made several agreements with ROK in line with Article 4(a), which includes various agreements concluded in 1965. While negotiating bilateral arrangements, ROK and Japan failed to answer many questions including the extent of Japan’s responsibility for the period of colonial subjugation of Korean Peninsula. Overall, the ambiguity of the Peace Treaty with Japan creates a great controversy among the states in the North-East Asia with regard to the interpretation of Article 2 which clearly reflects that there remain many questions unresolved.
