이 논문의 목적은 1701-1703년에 발생했던 이른바 「赤穗義人事件」을 통해, 근세 일본의 정치와 윤리를 살펴보려는 것이다. 赤穗事件은 1701년 赤穗藩主 淺野長矩가 막부의 고관 吉良義央을 실해하려다 실패하고 처형된 뒤, 1702년 그의 가신 46인이 吉良義央를 살해한 사건이다. 이는 주군을 위한 충성과 죽음이라는 무사도의 원형적 정신이 재현된 사건이었다. 그러나 그것은 사적 폭력의 행사를 엄금했던 幕藩制의 법적 원리와 배치되어, 46인은 切腹刑에 처해졌다. 요컨대 무사도의 윤리와 막번제의 정치원리가 정면으로 충돌하여, 무사들은 자신들이 세운 국가의 희생자가 되는 모순에 직면했다. 이 때문에 도쿠가와 일본의 정치적 주변인이었던 주자학자들은 무사의 심정윤리를 열렬히 옹호했다. 그러나 저명한 유학자 荻生?徠는 무사들의 脫法행위를 비판하고 막번제의 정치원리를 옹호했다. 이 사건은 뜨거운 논쟁을 불러일으켜 근대에 이르기까지 지속되었다. 이처럼 이 사건은 에도 시대를 뛰어넘어 오늘날에 이르기까지도, 일본인들에게 올바른 삶과 〈정치-윤리〉의 관계, 정치체제의 원리에 대한 원형적 사유를 함축하고 있는 것으로 생각된다.

This paper intends to understand the politics and ethics of Tokukawa Japan by examining so called Akou Event, which occurred during 1701-1703. It was an event which Akou’s 46 samuraies assassinated Kira Yosinaka who was an enemy of Asano Naganori, Akou samuraies’ Lord. Then, the Akou Event had a name for reviving the original spirit of bushido because Akou samuraies’ loyalty for Lord cost their lives. 46 samuraies suicided by disembowelment by order of Shogun. Their action violated the law of Shogunate system which prohibited the appeal to private violence. In sum, the ethics of Bushido was clashed against the political principles of Shogunate system. And it resulted in the death of the true samuraies so called. It was the fundamental contradiction between samurai’s ethics and his political system. Therefore, the Neo-Confucians, who were the social refugee of Tokukawa Japan in general, defended the Akou samurai’s ethics ardently. But Ogyu Sorai, the most famous Confucian in Tokukawa Japan, criticized the behavior of Akou samuraies and supported the political axioms of Shogunate system, He asserted that measures of government was indispensible for the preservation of peace and order, because Japan before Tokukawa Japan had experienced relentless violence for nearly one hundred years. That is true. But, it seems to me that Tokukawa Japan sacrificed the realm of ethics for the political peace too excess.
