개성공업지구의 부동산 법제 개선 방안 = A Study on the Legislation for Real estate management of the Gaesong Industrial Complex

국문 초록 (Abstract)

개성공업지구는 남북경제공동체를 완성하기 위한 디딤돌로서, 남북경협의 시금석으로 상징되는 대표적 사례이다. 개성공업지구는 2000년 착공하여 2005년 업체들의 입주가 시작되어다가 중단과 재개가 반복되다가 북한의 4차 핵실험 등으로 인해 2016년 2월 10일 전면 중단되었다. 현재 대북경협사업재개는 UN안보리제재와 미국의 독자제재 등으로 사실상 불가능한 상황이다. 기존의 논의되었던 제재 우회 방안 역시 사실상 의미를 잃게 되었다.
그러나 현재의 여건상 남북교류가 교착상태에 빠진 상황이라고 할지라도, 북한의 비핵화에 진전등으로 가까운 시일 내에 남북경협이 재개될 여지가 있다. 남북경협이 재개된다면 상징성과 성과, 기대 등을 고려할 때 그 시작은 개성공업지구가 될 것은 자명하다. 그동안 개성공업지구 법제 연구는 상당부분 진행이 되었으나 개성공업지구의 부동산을 중심으로 한 법제 연구는 상대적으로 미진하였다.
이에 본 논문은 개성공업지구의 부동산 관련 규정을 중심으로 향후 개성공업지구 재개에 따른 법제 개선사항을 고찰하였다. 주요 개선사항으로 토지이용권에 관한 사항, 집합건물의 관리규정, 부동산평가 방법 마련, 부동산공시제도, 기타 개성공업지구 법제화 제고 방안 등에 대해 검토하였다.

The Gaesong Industrial Complex is considered as the symbol of a touchstone economic cooperation and a stepping stone to the standards for completing the North-South economic community The construction of the Gaesong
Industrial Complex started in 2000. Since then, their relationship has continued to be on-again, off-again, and was completely suspended on February 10, 2016 due to North Korea s fourth nuclear test.
The resumption of the economic cooperation project with North Korea is virtually impossible due to The Security Council voted unanimously Saturday to punish Pyongyang for firing missiles and U.S. sanctions. so several options are being discussed is lost the meaning. However, even under the current environment, even if inter-Korean exchanges seems to be in a stalemate, regional economic cooperation will be reconvene the peaceful negotiations due to North Korea s progress toward denuclearization. All the while Legislation research in the Gaesong Industrial Area has progressed considerably, but the research on the legislation centering on real estate in the Gaesong Industrial Area has been relatively insufficient.
This paper consider the legal matters to be improved with the resumption of the Gaesong Industrial Area, focusing mainly on the provisions on real estate in the Gaesong Industrial Area. Major important matter included
matters concerning the right to use land, provisions for the management of collective buildings, creation of a real estate valuation method, and other measures to improve legislation in Gaesong Industrial Area.
