북한 저작권법의 내용 분석과 평가 = 남북한 저작권법의 비교를 중심으로

다국어 초록 (Multilingual Abstract)

The goal of this study is to analyze and assess the contents of copyright Law in North Korea through the comparison evaluation of North and South Korean copyright Law. The major research focused on the copyright legislative system of North Korea which includes the basic, the target of copyright, its right, the comparison of copyright term between North and South Korea and the comparison of their legislative system.
North Korea has operated the transformed copyright legislative system which accepted the copyright law originated from Capitalist market order and considered their system at the same time. So there exist many of Articles that South Korea can’t understand or not perfectly arranged. We can draw the conclusion which it will not be easy to distribute copyright works with North Korea in this situation. That is, they have continued the contents of copyright law originated from the contradictions inherent in the system.
For example, it is judged that copyrights are under the supervision of government and they preferentially considered the effect on their system in that the target of copyright works, government’s decision making on the price of copyright works, the absence of public transmission right in property right, 50 years copyright protection period and the counting point of copyright is the time of announcement. Therefore it is analyzed it is far from the universality of global society including the copyright of South Korea.
We can evaluate it into 3 major categories in this study. First, the difference of the copyright in North Korea, Second, the matters of universality embracing the troubles of opening, Third, there exist much more differences rather than similarities between the copyright of South and North Korea. These matters have suggested that we should seek the point of contact in the copyright exchange and cooperation for the future South and North relationships.
