건강기능식품 정책의 단절적 변동 분석 : 백수오 사건 전후의 정책변동 분석을 중심으로

국문 초록 (Abstract)

본 연구는 전 세계적으로 건강에 관한 관심이 증대하고, 건강관리의 예방적 패러다임이 강화되면서 건강기능식품에 대하여 증가하는 수요 및 이에 따른 피해 측면에 초점을 맞추어 특정 사건의 발생이 건강기능식품 정책에 미친 영향을 분석하였다.
2015년 4월 22일, 한국소비자원의 발표에 따라 가짜 백수오 사건은 엄청난 사회적 파장을 불러일으켰다. 이를 계기로 많은 소비자가 건강기능식품과 이를 규제하는 국가 정책에 높은 수준의 불신을 갖게 되면서 정책이미지가 크게 변화하였고, 이후 정부 정책은 규제를 더욱 강화하는 방향으로 대응책을 마련하였다.
본 연구에서는 이러한 백수오 사건 전후의 건강기능식품 정책변동을 분석함으로써 건강기능식품 정책이 단순히 백수오 사태라는 초점사건의 영향으로 단절적 변동을 경험한 것이 아님을 확인하였다. 물론 가짜 백수오 사건으로 각종 건강기능식품 규제정책이 신설 및 강화되었고, 이로써 기능성 원료 인정 건수가 급격하게 감소하는 등 단절적 정책변동이 발생하였다. 그러나 한편으로는 이러한 단절이 전적으로 백수오 사건에 따른 결과가 아니라, 그 이전부터 급격한 정책변동이 발생할 수 있는 환경이 축적되고 있었다는 점을 파악할 수 있었다. 연구결과, 이러한 환경적 요소에는 건강기능식품 이상사례에 대한 소비자 신고제도의 운영, 건강기능식품 규제정책의 변동주기 및 GMP 적용 의무화와 재평가제도 도입에 대한 기존 논의가 확인되었다.
즉, 소비자 이상사례 신고제도가 시행됨으로써 백수오 제품에 대한 소비자 피해가 표면적으로 드러날 수 있었고, 건강기능식품 규제정책이 강화되거나 완화되는 대략적인 주기를 보임에 따라 백수오 사건 이후에는 규제가 강화될 시점으로, 단절적 정책변동 발생의 환경이 형성되고 있던 것이다. 또한, 백수오 사건 이전에도 건강기능식품 제조업소에 대한 GMP 적용 확대 및 의무화 방안이 지속적으로 논의된 점과 기능성 원료 재평가제도 도입의 필요성이 국회 차원에서 제기된 부분 역시 급진적 정책변동이 초래될 수 있었던 환경적 요인으로 볼 수 있다. 더불어 본 연구에서는 단절적 정책변동이 비교적 쉽게 발생한 또 다른 요소로 명령지시적 규제를 설명한다.
정리하면, 본 연구에서는 가짜 백수오 사건 이후의 건강기능식품 정책이미지 변화, 기능성 원료 인정 건수의 급격한 감소와 각종 규제정책의 신설 및 강화라는 측면을 통하여 초점사건에 따른 건강기능식품 정책의 단절적 정책변동 발생을 확인한다.
나아가 초점사건 이전에도 지속적으로 논의되었던 GMP 적용 의무화 및 기능성 원료 재평가제도 도입이 정책으로 이어지지 못했던 과거 사례를 설명하고, 백수오 사건을 계기로 비로소 정책으로서 집행될 수 있었음을 설명한다. 이는 Kingdon의 <정책흐름모형>에서 ‘정책의 창’이 열리는 구조로도 이해될 수 있다. 이와 더불어 건강기능식품 부작용 추정사례에 대한 소비자 신고제도가 시행됨으로써 백수오 제품의 문제점이 검토될 수 있었던 환경이 조성되었음을 확인한다. 또한, 건강기능식품법이 시행된 이후의 건강기능식품 규제정책은 규제의 강화와 완화 측면에서 어느 정도의 반복적인 패턴을 보인다는 사실을 토대로, 백수오 사건 이후에는 규제강화적 기조가 지배적일 순서였음을 설명한다. 따라서 건강기능식품 정책이 가짜 백수오 사태라는 초점사건만을 계기로 단절적 정책변동을 경험한 것이 아니라, 이전부터 누적되어 온 환경의 역할도 큰 비중을 차지했음을 분명하게 확인하고자 한다.
이러한 분석을 토대로 본 연구가 초점사건 이후 발생한 건강기능식품 정책의 단절적 변동을 다방면에서 분석했다는 의의가 있는 반면에, 규제정책의 주기를 분석함에 있어서 주요 키워드를 중심으로 데이터를 확보 및 해석했다는 점에서 분석의 한계를 보인다. 따라서 향후 건강기능식품 정책 관련 연구에서는 정책의 변화를 연속선 상에서 분석할 수 있도록 자료의 양적·질적 증대가 이루어져야 하고, 단절균형 이론에 관한 연구는 변화에 따른 결과적 측면뿐만 아니라 단절적 변동이 발생하기까지의 축적된 환경에 대한 분석까지도 포괄할 필요가 있다.

다국어 초록 (Multilingual Abstract)

This study aims to analyze the impact of certain event on the policy related to health functional food(hereinafter referred to as HFF) by paying attention not only to the increasing demand but also to the damage aspects of HFF in Korea as interests in health and policy paradigm of preventive health care have increased around the world.
Following the announcement by the Korea Consumer Agency on April 22, 2015, the fake Cynanchi Wilfordii Radix(KHP) case caused enormous social repercussions. As a result, the policy image of HHF changed significantly as many consumers grow their distrust in health functional food and national policies regulating them. In addition, after the event, the government policy was then prepared to take countermeasures in a way that would further strengthen regulations.
This study identifies and confirms the fact that the HFF policy did not experience a punctuated change simply due to the focus event called the Cynanchi Wilfordii Radix event by analyzing the changes in HFF policy before
and after this event. Of course, various HFF regulations have been newly established and strengthened by the fake Cynanchi Wilfordii Radix incident, which resulted in a sudden decrease in the number of individually recognized functional ingredients by the Ministry of Food and Drug Safety.
On the one hand, however, this policy change was not entirely the result of the Cynanchi Wilfordii Radix incident, but it was possible to see that prior to that, there had been an accumulation of circumstances in which drastic policy changes could take place. The research finds three factors of these circumstances as having existed consumer reporting system for deviant cases in taking HFFs, the cycle of regulations change of HFF policy, and the continuous discussions on the operation of the mandatory application of GMP
and the introduction of a re-evaluation system of functional ingredients.
To summarize, this study firstly identifies the occurrence of a punctuated policy change in HFF regulations due to focus event by presenting great changes after the Cynanchi Wilfordii Radix event, which are the policy image change, the rapid reduction in the number of functional ingredient recognition, and the introduction and reinforcement of various regulatory policies of HFF.
Additionally, the study takes the characteristics of HFF policies as the government regulations into account for introducing another element that has made punctuated policy change could occur easily. Furthermore, it also
applies Kingdon’s Policy Flow Model on the study case to explain that ‘policy window’ would open by the Cynanchi Wilfordii Radix event, and thus a variety of problems related to HFF could be brought up to the surface all together and meet many new regulations.
As mentioned above, through this analysis, the study demonstrates that HFF policy has experienced a punctuated change not only from the focus event, but also by the role of the environment that had been accumulated until the event happened.
The study also has limitation in terms of analyzing data to be gathered and interpreted by a few keywords to confirm a pattern of HFF regulations from reinforcement to deregulation, whereas it is meaningful that the study analyzes the punctuated policy change through the various points of view.
Therefore, in future studies on HFF policy, it needs for HFF-related data to be collected enough quantitatively as well as qualitatively to allow policy changes to be analyzed in a continuous context. In addition, studies on the theory of punctuated equilibrium need to cover not only the resulting aspects of the change but also the analysis of the accumulated environment until the occurrence of a focus event.
