지방자치단체의 효과적인 범죄예방디자인 사업을 위한 매뉴얼에 관한 연구 = Study on the Manual for Effetive Crime Prevention Through Environmental Design Projet of Locl Government

국문 초록 (Abstract)

최근 매년 증가하고 있는 범죄율과 포악해지는 범죄로 인하여 주민들은 두려움에 직면해 있다. 이에 경찰에서는 범죄와의 전쟁 등을 통하여 범인 검거에 주력하고 법무부는 범죄자 교화 프로그램을 운영하고 있지만, 그 한계가 있어 정부에서는 대안으로 환경 개선을 통하여 범죄를 사전에 차단하는 범죄예방디자인에 관심을 두고 실행하고 있다.
그러나 범죄예방디자인은 국내에 도입된 지 얼마 되지 않아 여러 가지 문제점을 드러내고 있다.
먼저, 범죄예방디자인 관련 단일 법규 및 전담부서가 없어 행정체계가 갖추어지지 않았다. 둘째, 정책을 도입하기 위하여 필수적인 기본계획이 미비하여 체계적인 사업이 이루어지고 있지 않다. 그다음, 범죄예방디자인 사업의 가시적인 성과를 위하여 시범 사업 위주로 중앙부처 별로 제각기 이루어지고, 이를 수행하는 지방자치단체 또한 사업 방법을 달리 추진함에 따라 혼선을 빚고 있다. 그리고 사업의 문제점을 보완하고 발전시키기 위한 사후 결과 평가 방법이 미흡하다.
본 연구는 이러한 문제를 범죄예방디자인 사업의 주체가 어떠한 기본계획을 가지고 사업을 통합적으로 운영하고, 지속 가능한 사업 추진을 위한 사후 평가를 수행할 수 있는가에 초점을 맞추어 진행하기로 하고 해결 방법, 즉 효과적인 범죄예방디자인 사업을 위한 매뉴얼을 제안하는 것에 그 목적을 둔다.
그 세부 목적을 살펴보면 다음과 같다.
첫째, 사업기반을 구축하기 위하여 범죄예방디자인을 통합적으로 수행할 수 있는 행정조직 구성·운영 및 관련 법규 제정에 대한 필요성과 그것의 구체적인 구축 방법을 제시한다.
둘째, 범죄예방디자인이 타부서와 혼선 없이 체계적으로 운영되기 위한 기초 계획으로서 기본계획 작성의 가이드라인을 제안한다.
셋째, 지방자치단체에서 사업을 추진함에 있어 어떤 담당자가 진행하더라도 원활하게 실행할 수 있도록 정책 실현의 구체적인 방법인 시범사업과 단위사업에 대한 매뉴얼을 제시한다.
넷째, 차후 사업의 보완 및 개선을 위하여 사업 효과성 분석을 통한 평가 환류 체계 구축 방법을 제안한다.
그리고 본 연구의 목적을 달성하려는 방법은 다음과 같다.
우선 범죄예방디자인이 행정 정책과 어떤 연관성이 있는지를 분석하고 관련된 내용을 바탕으로 행정조직 구성·운영 방안과 관련 법규 제정 필요성 등을 제시하여 사업 기반을 구축도록 하였다.
또한, 기본계획의 필요성과 내용을 정리하였으며, 범죄예방디자인 사업은 여러 기관과 단체·주민과 함께 협력체계를 유지하여야 함에도 행정기관 주도의 소통 부재로 인한 문제점을 네트워크 이론을 바탕으로 분석하여 상호 협조가 원활하게 이루어지도록 하는 등 정책 도입 시에 필요한 사항을 제안하였다.
셋째, 시범사업의 가이드라인을 제시하고 시범사업으로만 미흡한 점을 보완하기 위하여 단위사업을 조사·발굴하여 기술하였으며, 추가로 주민활동의 중요성이 대두함에 따라 그 내용을 정리하였다.
마지막으로 사업의 효과성 분석 방법에 대하여 연구하여 지속 가능한 사업이 되도록 평가 환류에 대하여 논하였으며, 언론에서 지적하고 있는 유지·관리의 문제를 해결하기 위한 업무 구분에 대하여 언급하였다.
위와 같은 연구를 위하여 범죄예방디자인 이론을 고찰하고, 비교적 체계적으로 시행하고 있는 서울특별시 동작구의 사례를 중심으로 분석하였다.
그 결과 좀 더 효율적이고 효과적인 사업추진을 위하여, 우선 행정 기반 구축을 위한 전담부서를 구성하고 법적 기반 구축을 위한 관련 법규를 제정해야 한다. 또한, 기본계획 수립과 네트워크를 형성하여 체계적으로 정책이 도입될 수 있도록 하며, 주민활동을 전제로 하여 시범사업과 단위사업을 추진함으로써 사업이 조속하게 확산되도록 해야 한다. 끝으로 정확한 효과성 분석을 통하여 원활한 평가 환류가 이루어질 수 있게 단계별 매뉴얼 작성이 필수적인 것으로 나타났다.
이 연구는 범죄예방디자인 업무를 수행하는 최일선 기관인 지방자치단체의 담당자가 쉽고 편리하게 추진하도록 매뉴얼을 작성하여 좀 더 효과적이고 체계적인 사업이 되도록 도움을 주는 데 의의가 있다. 아직 이러한 행정 전반에 걸친 매뉴얼이 작성된 사례가 없어 본 연구의 결과가 범죄예방디자인 행정 정책에 참고 자료가 될 것으로 기대된다.
지방자치단체의 성공적인 범죄예방디자인 정책 실현을 위해서는 많은 행정 과정과 사업추진이 필요함에 따라 매뉴얼의 내용도 방대하여 모든 것을 논할 수 없는 한계가 있는 것이 사실이다. 따라서 본 연구에서는 핵심적인 사항에 대해서만 다루는 것으로 하고, 추후에 행정 단계별로 세부적으로 나누어 연구할 기회를 갖도록 하겠다.

다국어 초록 (Multilingual Abstract)

Due to the increasing crime rate and the crime becoming more vicious year by year recently, the residents are facing with fear. Hence, the police is concentrating on arresting the criminals and the Ministry of Justice is operating edification program, but there is a limit. Therefore, the government is putting concern to the crime prevention through environmental design which blocks a crime through environmental improvement in advance, and implementing it.
However, as the crime prevention through environmental design has a short history after being introduced domestically, it has been exposing several problems.
Firstly, as there is no unitary laws & regulations and the Department which exclusively takes charge of the crime prevention through environmental design, an administrative system has not been established. Secondly, as the basic plan essential to introduce the policy is still incomplete, so a systemic project is not being implemented. Next, the business is being progressed respectively by Central Department focusing on the demonstration project for visible performance of the crime prevention through environmental design project, and the local autonomous entity which proceeds with it also pushes the project method ahead separately, too, therefore they are causing confusion. In addition, the evaluation method for the expost facto result to complement the problem of the project and develop it is incomplete.
This research shall be progressed focusing on the matter how the subject of the crime prevention through environmental design project would operate the project by integration having what kind of basic plan for above problems, and whether the expost facto evaluation for the promotion of the sustainable project could be implemented, and it aims to suggest a solution, i.e., a manual for the effective crime prevention through environmental design project.
The detailed purpose is as follows.
Firstly, it shall suggest the necessity for composition·operation of an administrative organization which can implement the crime prevention through environmental design by integration in order to establish the business basis and the enactment of the relevant laws & regulations, and suggest the concrete establishment method.
Secondly, it shall suggest the guide line for drawing-up of the basic plan as a prime plan for systemic operation of the crime prevention through environmental design without confusion with other departments.
Thirdly, it shall suggest a manual of the demonstration project and the unit project which are the concrete method to realize the policy so that the project may be carried out smoothly regardless of the person in charge when a local autonomous entity promotes the project.
Fourthly, it shall suggest the establishment method for an evaluation feedback through the analysis of the business effectiveness in order to complement and improve the project in the future.
And the method to achieve the purpose of this research is as follows.
Above all, we have analyzed what interrelation with the administrative policy the crime prevention through environmental design would have, and let the business basis established by suggesting the necessity of the composition·operation plan of an administrative organization and the enactment of the relevant laws & regulations based on the relevant contents.
In addition, we have arranged the necessity and contents of the basic plan, and suggested the necessary items when introducing the policy, such as analyzing the problem due to the lack of the communication even though the collaboration system of the crime prevention through environmental design project should be maintained together with various organization and the resident, based on the network theory, and let mutual cooperation be realized smoothly.
Thirdly, we have suggested the guide line of the demonstration project, and described the unit project by investing and excavating it to complement the shortcomings only with the demonstration project, and additionally arranged the contents as the importance of the residential activities is raised.
Lastly, we have discussed about the evaluation feedback so that it can become the sustainable project by analyzing the effective analysis method on the project, and mentioned about the work scope to solve the matter of maintenance·management pointed out by the press.
For the above research, we have examined the theory of the crime prevention through environmental design and analyzed it centering on the case of Dongjak-gu, Seoul Special City which is implemented systemically, comparatively.
As a result, in order to promote the project more efficiently and effectively, a Department which shall exclusively take charge of the establishment of administrative basis should be organized above all, and the relevant laws and regulations to establish legal basis should be enacted. In addition, in order for a policy to be introduced systemically, the setting up of the basic plan and a network should be formed, and let the project spreaded quickly by promoting the demonstration project and the unit project subject to the activities of the residents. Lastly, it was found that the drawing up of the manual by step is essential so that a smooth evaluation feed back may be realized through the precise analysis of the effectiveness.
This research have a significance on helping to make more effective and systemic project by drawing up the manual so that the person in charge in the local autonomous entity, the frontline organization which performs the crime prevention through environmental design work, may promote the project easily and conveniently. As there is no manual drawn up throughout the whole administration like this yet, it is expected that the result of this research will be a reference data for the administrative policy of the crime prevention through environmental design.
In order to realize the crime prevention through environmental design policy of the local autonomous entity, many administrative procedures and the project promotion are required, therefore, it is true that the contents of the manual is too extensive to discuss everything. Therefore, the core issues shall be dealt with in this research, and we will have opportunity to research by assorting it in detail by administrative stage later.
