미국 수정헌법 제1조의 보호가치 고찰

국문 초록 (Abstract)

2001년 9. 11. 테러 이후 국제사회는 테러리즘과의 전쟁에 대비한다는 명분 하에 개인정보를 무제한적으로 검열하고 검색함으로써 표현의 자유의 근본이 흔들리고 있다. 우리는 남북분단이 극복되지 않은 상황에서 진영논리에 매몰돼 자칫 표현의 자유, 언론의 자유가 위협을 받게 되는 것 아닌가 하는 우려를 낳고 있다. 더욱이 정보통신기술의 발달에 따라 다매체 다채널시대가 열리면서 표현을 위한 기회가 무한으로 확대되고 있다. 전통적인 신문, 방송뿐 아니라 인터넷과 SNS를 통한 즉시적인 표현이 이뤄지고, 서로 소통하는 시대가 되고 있다.
수정헌법 제1조는 표현의 자유와 언론의 자유의 출발점이다. 이 출발점은 또 모든 인권, 기본권의 출발점이기도 하다. 더 나아가 사상의 자유시장을 확대하게 하는 언론활동의 기본교리이기도 한다. 이런 가운데 미국 수정헌법 제1조에서 유래한 인류보편의 가치가 심각한 도전에 직면하기도 한다. 표현과 소통을 통한 진리에의 도달과 자기실현, 공동체의 건전한 의사결정 더 나아가 안정과 변화 사이의 균형을 통한 공동체의 지속가능한 발전이라는 가치가 침해를 받기도 한다.
이 연구에서 추구하고자 하는 것은 수정헌법 제1조의 보호가치를 통해 사상의 자유시장을 확고하게 방안은 무엇인지를 찾고자 하는 것이다. 사상의 자유시장은 공동체의 활력을 되찾게 하고 자유민주주의를 발전하게 하며, 지속가능한 번영을 이끌어 낼 것이다. 수정헌법 제1조를 천착하고자 하는 것은 바로 이 같은 반대론과 비판론에 주목하면서 공적 토론장을 확대할 이론적 가능성을 모색하기 위한 것이다.
이번 연구에서는 표현의 자유가 지향하는 가치를 네 가지로 분류한 에머슨의 이론을 원전에 충실하게 해석하고 여러 학자들의 견해를 통해 이를 검증해본다. 수정헌법 제1조의 가치들은 서로 유기적으로 연계가 돼 있다는 생각이다. 표현의 자유에 관한 미국 법원의 판례들을 분석하고 관념적 세계인 사상의 자유시장을 현실 세계로 구체화하면서 우리나라에서 공적 토론장을 확대하는 계기를 촉구하려고 한다. 또한 지속가능한 자유민주주의를 구축하는 방안을 찾는데도 초점을 맞출 것이다.

다국어 초록 (Multilingual Abstract)

After the 9. 11. Terror, 2001, many countries have intensified to censor and to investigate personal informations against terrorism, so the bottom of freedom of expression is deteriorated. While we are not getting over the split of our country, we are drowned in the struggle of ideology and we are threatened of freedom of expression and freedom of press. Furthermore, as the technology of information and communication is being developed, the era of multi-media and multi-channels is opened and the opportunities for expression are expanded infinitely. We can express and communicate immediately our ideas not only by traditional news papers, broadcast but also by internet and SNS etc..
In this situation I believe that people can realize the universal values derived from the First Amendment and may encounter the severe challenges. The values of freedom of expression i.e. the attainment of truth, self-fulfillment, participation in decision-making, sustainable growth by balance between stability and change are realized and abridged. The First Amendment is the starting point of freedom of expression and press. And this is also that point of all human rights and basic rights. Furthermore it is the doctrine of media activities for expanding of the marketplace of ideas.
At this study I have tried to search the best way how to expand the marketplace of ideas through the First Amendment’s Protecting Values. The marketplace of ideas will recover its vitality, develop liberal democracy and induce to the sustainable prosperity of community. At the end we will be able to find out the possibility of expanding public forum scrutinizing anti-theories and critic theories.
I have tried to analyze the original theory of T. Emerson who categorized the values which people are trying to get by freedom of expression are into four. I think tha the values are related systematically each other. I have tried to interpret American court’s cases and hope to build the marketplace of ideas which is the ideal marketplace into our reality. Till the last I have tried to study the direction of expanding freedom of expression, and I will focus to find out the way to strengthen liberal democracy in Korea.
