국문 초록 (Abstract)

이 논문은 예(禮)의 기원과 예(禮) 이념의 전개, 그리고 국가례(國家禮)의 전형으로서의 『주례(周禮)』와 조선 오백년의 법적 기틀을 마련한 『조선경국전(朝鮮經國典)』을 고찰한 것이다. 주지하다시피 예(禮)는 제물을 차려 놓고 신(神)에게 복을 비는 것에서 시작되었다. 이러한 예(禮)의 기원이 사회가 복잡해지면서 예의 기능은 크게 ‘개인의 자율성에 기반 한 예’, ‘타인과의 윤리성에 바탕한 의례’, ‘사회의 제도적인 측면을 다룬 전례’, ‘국가의 통치 구조와 관련된 법제’로 구분된다. 국가의 통치 구조와 관련된 법제의 성격이 강한 저서가 바로 『주례』이다. 『주례』의 저자에 대해 이설이 있으나, 이 책이 중국을 비롯한 유교 국가에서 가장 모범이 되는 법전임에는 이의가 없다. 북주(北周)의 육관(六官) 제도는 물론 수(隋)·당(唐)에서 청말(淸末)에 이르는 육부(六部) 제도도 바로 『주례』의 체제를 따랐으며, 중국의 『대당개원례(大唐開元禮)』, 『통전(通典)』, 『당육전(唐六典)』, 『회전(會典)』은 물론 정도전의 『조선경국전』, 『경국대전』, 『속대전』, 『대전통편』, 『대전회통』, 『반계수록』, 『경세유포』 등도 모두 『주례』을 이념과 체제를 바탕으로 저술된 것이다. 특히 정도전의 『조선경국전』은 조선 왕조 5백 년의 기틀을 마련한 건국 법전으로서 비록 이 책이 공식적인 법전으로서 기능은 하지 못했다 하더라도 『경국대전(經國大典)』 편찬의 모체가 되었던 것이다.

다국어 초록 (Multilingual Abstract)

The purpose of this study is to analyze the origin of Confucian proprieties, the development of its idea, Jurye(주례(周禮)) as a representative model of national rituals and Joseongyeonggukjeon(조선경국전(朝鮮經國典)) contributed to establishing the legal foundation of Joseon Dynasty. It is a matter of common knowledge that the proprieties were originated from rituals to pray to god for happiness and good luck offering sacrifices. As the society becomes more complicated and diversified, the functions of the proprieties were divided into four categories: ``the proprieties performed at one`s own discretion``, ``ceremonies based on the ethicality shared with other people``, ``national rituals in relation to institutional aspects of society`` and ``legislative system connected to nation`s ruling system``. Jurye is a book that is closely related to nation`s legislative system linked to its governing structure. There are different opinions about the author of the book; however, no one denies that it is the most exemplary book on laws in Confucianism nations including China. The legal system presented in the book not only gave rise to the Six-Office System of Northern Zhou and the Six Ministries operated from Sui and Tang periods to the end of the Qing Dynasty but also heavily influenced the contents of Daedanggaewonrae(대당개원례(大唐開元禮)), Tongjeon(통전(通典)), Dangyukjeon(당육전(唐六典)) and Hoejeon(회전(會典)). In addition, Gyeonggukdaejeon(경국대전(經國大典)), Sokdaejeon(속대전(續大典)), Daejeontongpyeon(대전통편(大典通編)), Daejeonhoetong(대전회통(大典會通)), Bangyesurok(반계수록(磻溪隧錄)) and Gyeongseyupyo (경세유표(經世遺表)) as well as Jeong Don-jeon`s Joseongyeonggukjeon were written on the basis of the idea and system of Jurye. In particular, Joseongyeonggukjeon written by Jeong Do-jeon provided the fundamental base for the compilation of Gyeonggukdaejeon as the foundation constitution of Joseon Dynasty, although it did not function as an actual code of laws at that time.
