A3-5 : 다자간 항공협정과 항공안전에 관한 연구 : 한/EU를 중심으로 = A study on the multilateral agreement and Safety of international air transport with EU

국문 초록 (Abstract)

유럽연합(EU)은 유럽 내 단일 항공시장을 구축하고 연합 내 비차별주의 원칙에 따라 제 3국과 항공협정 시 HA협정을 통한 EU Clause의 수용을 요구하고 있다. 우리나라는 EU와 긴밀한 항공시장을 형성하고 있기에 EU당국은 우리 측에도 항공협정 시 기존의 양자협정방식에서 HA협정에 따른 EU Clause 적용을 요구하고 있다. EU집행위원회가 요구하는 HA협정은 개별 회원국의 협상권을 위임받아 체결하는 협정이기에 유럽연합외 국가와 항공협정체결 시 이는 회원국에 일괄 적용되는 효과를 가진다. 항공협정은 국가 간의 합의로서 이는 필히 안전성을 전제로 이루어져 하기에 HA협정 체결 시 전 EU 개별 회원국의 항공 안전도를 면밀히 분석해야 할 필요가 있다. 본 논문은 한-EU간 변화된 협정 방식에 항공 안전도를 고려하여 보다 효율적이고 안전한 우리나라의 협상 방안에 대하여 연구하여 제시하고자 한다. 연구는 주요 4개의 항공안전성 평가를 소개하고 그 중 평가항목 수치화 되어 전 세계에 공개되고 있는 ICAO의 USOAP 을 중심으로 평가 결과 기준 하위20%의 EU회원국에 대해 구체적으로 진행하고, 더 나아가 우리나라에 최적화 된 자체적인 안전성 평가 수립의 필요성을 제시하고자 한다.

Europe union calls for setting a single aviation market in its regions and adjusting EU Clause through horizontal agreement(HA), when making a air transport agreements between the third countries by means of “Non-discriminate rules”. Since Republic of Korea and EU has a strong relationship in airline industry, EU therefore suggests implementing the EU clause through the HA agreement for making a air transport agreements which used to be made bilaterally Agreement(BA). Commission of the European communities as a right to make an agreement for other participating countries by the HA agreement between them. Then, such agreements are in effect to the participating country. Since, safeness, is required certainly prior to making a air transport agreements, analysing the aviation safety of distinctive countries of EU is necessary before making a HA agreements. This research suggests negotiation measures that are more efficient and safe, considering aviation safety subject to modification of agreement measurement between Republic of Korea and EU. The research introduces four of authorized safety oversight program. And the research focuses on the countries of bottom twenty percent based on ICAO USOAP evaluation model, one of the safety oversight program, which shows figures of evaluated models worldwide. Furthermore, it suggest the needs of setting the safety evaluation models optimized especially for Republic of Korea.
