인권의 제도화 과정에 관한 연구:지방정부간 확산 과정에서 고독사 조례의 제도화 수준 분석 = Institutionalization Process of Human Rights: Analysis of the Institutionalization Level of Ordinances on Lonely Death in Diffusion Process between local governments

국문 초록 (Abstract)

본 연구는 고독사를 예방하기 위한 조례가 지방정부간에 확산됨으로써 보다 나은 제도화의 수준을 이루는 과정을 인권의 제도화로 보는 관점에서 고독사 조례의 제도화 수준을 분석하였다. 이론적으로는 제도론적 관점과 제도화 및 제도화 과정의 개념을 설명하고, 실증적으로 제도화 수준의 변화를 인권･복지제도의 규범적 기준에 따라 시기별로 분석하였다. 분석결과, 전체 구간동안 조례의 누적채택수와 제도화 수준 모두에서 완만한 S자 곡선의 형태가 나타났으며, 이를 통해 제도화의 외연적 측면과 내연적 측면 모두에서 제도화 과정의 모형이 성립함을 발견하였다. 또한, 고독사 조례의 제도화 수준에는 지방정부간에 학습과 모방, 경쟁 기제가 작용하는 한편, 고독사예방법의 영향은 기초 및 광역자치단체와 규범적 기준에 있어서 다르게 나타났다. 이를 통해 제도화 과정에 어떠한 확산기제가 작용하는지에 따라 제도화의 수준이 결정될 수 있음을 확인하였다. 본 연구는 고독사 조례의 제도화 수준의 분석을 통해 시간적 측면과 확산기제를 고려하면서 기존의 제도주의적 접근과 확산 연구와의 접점을 이루고자 하는 점에서 의미를 가진다.

This study analyzed the level of institutionalization of lonely death prevention ordinances from the perspective of human rights institutionalization. Theoretically, it explained the institutional perspective and the concepts of institutionalization and the institutionalization process. Empirically, it analyzed the changes in the level of institutionalization over time according to normative criteria for human rights and welfare institutions. The analysis revealed a gradual S-curve pattern in both the cumulative number of ordinance adoptions and the level of institutionalization throughout the entire period, demonstrating the model of institutionalization process for both external and internal aspects of institutionalization. Additionally, the study found that learning, imitation, and competition mechanisms operated between local governments in the level of institutionalization of lonely death ordinances. However, the impact of the Lonely Death Act differed between basic and metropolitan local governments and in terms of normative criteria. This confirmed that the level of institutionalization can be determined by the diffusion mechanisms at work in the institutionalization process. The significance of this study lies in its attempt to bridge the gap between existing institutional approaches and diffusion research by analyzing the level of institutionalization of lonely death ordinances, considering temporal aspects and diffusion mechanisms.
