국문 초록 (Abstract)

지금까지 북한이탈주민정착지원에 관련된 법률상의 북한이탈주민에 대한 지원 체계와 업무 분장은 시대적인 상황과 북한이탈주민들의 국내 입국 추이의 변화에 따라 변화하여 왔으나 현재까지 이들 업무가 중앙정부의 사무 즉 국가 사무로만 취급되어 온 점에는 변화가 없다. 그 결과 현재 지방자치단체는 북한이탈주민에 대한 지원체계에 있어서 단순히 중앙정부의 정책을 집행하는 도구적인 하부행정기관에 불과한 역할을 맡고 있을 뿐이며 정책입안 등에 있어서 사실상 소외되어 있다. 또한 지방자치단체의 입장에서도 국가사무로만 되어 있는 이상 적극적으로 관여하기 어려운 것이 사실이었다.

그러나 현실적으로 북한이탈주민의 사회 적응 및 정착에 있어서 해당 지방자치단체가 가장 밀접한 연관성을 가지고 있다는 점은 너무도 명백하며, 또한 독일의 예에서 알 수 있듯이 향후 남북지방자치단체간의 교류협력은 통일 과정에서 사회통합, 행정통합의 측면에서 매우 큰 역할을 하게 될 수 있으므로, 현재 각 지방자치단체에 거주하고 있는 북한이탈주민에 대한 이해와 이들의 성공적인 정착을 위한 지원은 향후 지방자치단체의 북한 및 북한 주민에 대한 이해도를 높이는데 크게 기여할 수 있다.

따라서 중앙정부가 북한이탈주민지원 정책에 대한 유일한 주도권을 가지고 지방자치단체는 단순히 중앙정부의 정책을 집행하기 위한 도구적인 하부행정기관에 불과한 지금의 상황은 개선될 필요가 있으며 이를 뒷받침하고 지방자치단체의 적극적 참여를 이끌어내기 위한 법제정비의 필요성이 크다.

구체적으로, 북한이탈주민에 대한 정착지원업무와 관련 ‘국가와 지방자치단체의 책임’을 명시하고, 이들 사무를 ‘국가 및 지방자치단체의 공동사무’로 전환하며, 북한이탈주민대책협의회에 지방자치단체 협의체에서 추천한 자를 포함시키고, 지방자치단체에게도 비용부담의무를 부과하는 등 지방자치단체의 참여의 폭을 대폭 확대시킬 수 있는 방향으로 정착지원법을 개정할 필요가 있다.

다국어 초록 (Multilingual Abstract)

Cooperation with national and local governments is important to solve the problem of successful settlement of North Korean defectors. However, the local governments are still under the control of the national government and just means of implementing the policy of the national government, in dealing with the matter of supporting the North Korean defectors.

The main reason for the problem is that by law, the scope of activities regarding the North Korean defectors is in the only control of the national government, so the local governments do not have authority and control over the matter of North Korean defectors.

However, it is important to focus on the role of local government in the field of helping North Korean defectors to settle in the local areas successfully. Exchanges and cooperations between East and West Germany's local governments had played on important role in the reunification of the two different countries especially in promoting mutual understanding and changing in perception of unification. Likewise, exchanges and cooperations between South and North Korea's local governments will play on important role. To achieve this, the understanding of the North Korean defectors and their experiences of successful settlement are very helpful for the local government to prepare the exchanges and cooperations with North Korean local governments and the reunification of Korea.

But in the law level, the current laws regulating North Korean defectors lacked care in the role of local governments in the course of Korea reunification.

Therefore, it is necessary to redesign the legal system to support and promote the role of local governments in dealing with the North Korean defectors issues.

First, it is necessary to put in an additional article that admits local government as a joint institution of the North Korean defectors issues with the national government.

Second, the members recommended by the local governments should come under the consultative council on North Korean defectors issues.

Finally, it is also desirable that the local governments be given the responsibility of being involved with the North Korean defectors issues by law.
