콜버그는 칸트주의자인가? = 도덕발달의 철학과 도덕법의 철학

국문 초록 (Abstract)

콜버그의 도덕발달론의 개념은 칸트의 도덕법의 철학과 같이 형식주의적 특징을 가지고 있다. 콜버그는 도덕성을 내용보다는 도덕판단의 형식적 특징을 가지고 규정하였다. 그는 자신의 발달이론에서 ‘적절성’이라는 형식주의적 기준을 주장하는데, 이 기준은 보편성과 보편화 가능성이라는 형식주의적 도덕철학의 기준과 평행적이다. 콜버그가 정립한 단계 6의 보편적인 정의 원리는 칸트가 정식화한 정언명령과 같은 것이다. 이런 점에서 콜버그는 진정한 의미에서 칸트주의자이다.
그러나 콜버그에게 가끔 칸트의 정언명령은 모든 사람과 모든 상황에서 뿐만 아니라 절대적으로 옳은 행위라고 규정되는 어떤 상황에서조차도 보편적이지 않은 것으로 생각되었다. 정언명령은 제도화된 규칙이나 실체적 정의가 규정하는 내용들을 제시할 수 없었던 것이다. 이러한 경우에 정언명령은 단계 6에 속하지 않고 단계 4에 속한다. 콜버그는 도덕판단의 완전한 보편화 가능성을 위하여 형식적인 것을 넘어서서 실체적 도덕원리를 요구한다. 그는 도덕원리로서 정의 원리, 인간에 대한 존중, 평형화된 역할채택의 기본 진술로서의 가역성과 같은 보다 보편적인 도덕 지향을 주시하였다. 콜버그는 자신이 단계 6이라고 불렀고, 칸트가 단지 부분적으로 다루었던 이론과 방법을 롤즈가 처음으로 분명하게 체계적인 정당화를 수행했다고 보았다. 콜버그의 발달론적 조망에서 도덕원리는 경험의 능동적인 재구성이다. 그러나 도덕판단이 요구하는 보편적 형식은 인간의 보편적이고 선험적인 직관이 아니고 단계 5에서 단계 6으로의 발달과정에서 판단을 보편적으로 재구성하는 영역이다.
칸트는 종교적 이념들이 완전한 인간과 완전한 윤리적 공동체(지상에서의 하느님 나라로서의 교회)의 이념에 대한 도덕적 구조의 연장이라고 보았다. 여기에서는 계시, 기적, 일치의 신비 경험을 요구하지 않고 단지 도덕성과 도덕적 이성에서의 신앙만을 요구할 뿐이다. 콜버그에 의하면 칸트는 더 이상의 형이상학적, 신비적 통찰을 배제한 도덕성의 형이상학에 기초한 단계 7을 제안하였다. 그러나 단계 7에 대한 콜버그의 통찰은 스피노자, 마르쿠스 아우렐리우스, 화이트헤드, 떼이야르 드샤르댕의 이론과 더불어 자연법의 방향을 취하고 있다. 이러한 사실들이 콜버그가 칸트주의자일 수 없는 이유이다.

다국어 초록 (Multilingual Abstract)

Kohlberg"s conception of moral development theory is formalistic like Kant"s of philosophy of moral law. Kohlberg defines morality in terms of the formal character of a moral judgement, rather than in terms of its content. He claims in his developmental theory formalistic criteria of adequacy, this criteria are parallel to formalistic moral philosophy"s criteria of universality and universalization. What Kohlberg earlier termed the universal principle of justice of stage 6, formulated by Kant as the categorical imperative. In these contexts Kohlberg is a really Kantian.
For Kohlberg it has sometimes been thought that Kant"s categorical imperative are not only universalizable to all people and all situations but are also absolutely definitive of right action in any situation. Kant"s categorical imperative could not provide plausible weights to either institutionalized rules or substantive justice in their determinations. In this case it belongs to not stage 6, but stage 4.
Kohlberg claims that full universalization of moral judgement requires more than a formalistic claim, it requires substantive moral principles. He sees a more universal moral orientation, which defines moral obligation in terms of what may be conceived as the principle of justice, of respect of personality, or of reversibility as fundamental statement of equilibrated role taking. For Kohlberg, Rawls"s theory is that it represents the first clear systematic justification of the principles and methods of decision he calls ‘Stage 6’, principles and methods only partly articulated by Kant. Moral principles for Kohlberg"s developmental perspective are active reconstructions of experience. But the universal form that moral judgement demands is not a universal a priori intuition of humanity, but a portion of the universal reconstruction of judgement in the process of development from stage 5 to stage 6.
Kant holds that religious ideas are the extension of moral structures to the idea of a perfect person and a perfect ethical community (church as Kingdom of God on earth). Such an intention requires neither revelation and miralcles nor mystical experiences of union but only requires faith in morality and moral reason. For Kohlberg, Kant suggests a version of ‘Stage 7’ based on a metaphysics of morality and without further metaphysical or mystical insight. But Kohlberg"s insight to ‘Stage 7’ leads rather in a ‘natural law’ direction, with theories of Spinoza, Marcus Aurelius, Whitehead, Teilhard de Chardin. These are the reason that Kohlberg is not able to hold a Kantian.
