입헌주의의 내면화를 위한 한국 민주시민교육의 현황과 과제 = The Status and Challenges of Korea's Democratic Citizenship Education for the Internalization of Constitutionalism

국문 초록 (Abstract)

입헌주의에 대한 강한 애정과 충성심은 바로 교육을 통해 길러질 수 있다. 즉 교육을 통해 입헌주의를 내면화함으로써만 가능하다. 일찍이 독일은 자신들의 잘못된 판단으로 독일 입헌주의가 파탄에 이른 경험을 각인하여, 과거에 대한 철저한 기억과 청산으로 역사의 과오를 되풀이 하지 않도록 훈련하고 있다. 특히 그 암흑의 역사 속에서도 민주주의에 대한 신념을 잃지 않고 그 적들과 의연히 맞선 평범한 독일국민들의 일화를 발굴ㆍ전파함으로써 헌법적 대화의 창구를 활짝 열고 있다. 무엇보다 독일연방차원에서 합의된 이른바 "보이텔스바흐 협약(Beutelsbacher Konsens)"과 독일기본법을 이탈하지 않는 한, 정치교육의 주체가 정치재단, 시민사회단체, 교회나 노조이거나를 불문하고 적극적인 지원을 아끼지 않는다는 점이다. 이것은 과거의 역사에 대한 합의와 독일기본법에 대한 합의, 그리고 "보이텔스바흐 협약(Beutelsbacher Konsens)"이라는 최소한의 합의가 있었기 때문에 가능한 것이었다.
그러나 한국의 민주시민교육의 현실은 이러한 독일의 정치교육의 모습과 전혀 다르다. 무엇보다 우리에겐 민주주의가 거꾸로 퇴행하는 것을 막아줄 방지턱조차 마련되어 있지 아니하다. 한국 민주시민교육은 과거의 역사에 대한 기억과 반성, 그리고 청산으로부터 다시 시작해야 한다. 다시 말해 입헌주주의의 퇴행을 막는 방지턱부터 설치해야 한다. 즉 한국 민주시민교육의 출발점은 입헌주의의 퇴행을 막았던 과거의 역사에 대한 합의와, 그 기본 목표와 방향 모두 입헌주의를 내면화하는 과정에 맞추어져야 한다는 합의가 동시에 이뤄지지 않는다면, 한국의 입헌주의와 대한민국의 주권자로서의 국민의 삶은 매우 험난할 것임이 분명하다.

다국어 초록 (Multilingual Abstract)

Strong affection and loyalty towards constitutionalism can be developed through education. In other words, this can be achieved by the internalization of constitutionalism. From early on, Germans became aware of how bad judgment led to the fall of the constitution and have thoroughly trained themselves to not repeat past mistakes. Even in the darkest of times, they did not lose their faith in constitutionalism and opened the doors to consitutional dialogue by spreading word of ordinary citizens who stood against the enemy. With the establishment of the Beutelsbacher Konsens at the federal level, all types of organization including political parties, civic groups, churches and labor unions have provided solid support for political education as long as consitutional laws are adhered to. This was possible because of the widespread consensus on history, German constitutional laws as well as the Beutelsbacher Konsens.
However, the reality of democratic citizenship education in Korea is completely different from Germany's political education. Above all, Korea has not established measures to prevent the degeneration of democracy. Democratic citizenship education in the country must forge a new beginning based on lessons of the past and self-reflection. That is, preventive measures should be introduced to counter the possible regression of democracy. It should be agreed that the starting point of democratic citizenship education is the history of preventing democratic regression, and that the basic goal and directions are focused on the internalization of constitutionalism. If such a consensus is not reached, Korea's constitutionalism and the lives of its citizens as sovereigns are bound to face a bleak future.
